Landis expressed her concern on <br />the amount of money that would be requested. Lancaster made a <br />motion and Long seconded to approve resolution # 98-0029 and <br />approve the interlocal agreement and to spend the $3,000.00 <br />requested but not exceed $5,000.00. Long, Abernethy, Hartman and <br />Lancaster voted yes. Quandt and Landis voted no and Stelk <br />abstained. Motion carried. <br /> <br />RESOLUTION #98-1l.f22 q <br /> <br />WHEREAS, The County Boards of Adams, Hall, Merrick, Phelps, Kearney, Buffalo, Dawson, <br />and Hamilton Counties have previously passed Resolutions to develop a local land use plan, including but <br />not limited to a written description of each counties environment, custom, culture, history, tax base and <br />community stability of each county, for purposes of preparation and use of such local land use plan in <br />Federal Decisions Making Processes with such eight counties utilizing one consultant and common <br />program of implementation of such anticipated land use plan for each county; and <br /> <br />WHEREAS, development and formulation of such a local land use plan, including but not limited <br />to a written description of each county's environment, custom, culture, history, tax base and community <br />stability appears to be a prerequisite to any effective standing and basis to discuss and dispute any federal <br />agency decision making process impacting each county's environment, custom, culture, history, tax base <br />and/or community stability; and <br /> <br />WHEREAS, formulation of such a local land use plan would best be accomplished by an <br />interlocal agreement among the above-named counties to retain the services of one land use planner <br />familiar with federal laws and regulations concerning the need to create such a local land use plan; and <br /> <br />WHEREAS, this Board has reviewed professional services contract of the Budd-Falen Law <br />Office, P.e. of Cheyenne, Wyoming concerning rendition of profession services concerning development <br />and formulation of such local land use plan for the eight above-named counties; and <br /> <br />WHEREAS, each and all counties involved would benefit from the sharing of costs to formulate <br />this initial plan estimated to cost approximately $25,000, with each county paying one-eight of such <br />amount and any necessary updating of this plan; and <br /> <br />WHEREAS, a local County Commission needs to be created for this County to help create such <br />local land use plan necessary for involvement in federal policy making decisions. Such local County <br />Commission would also review and make recommendations to this Board as to changes needed to this <br />county's land use environmental planning ordinances or need of adoption of the same. <br /> <br />NOW THEREFORE, be it resolved that this County enter into an Interlocal Agreement with the <br />Counties of Adams, Merrick, Phelps, Kearney, Buffalo, Dawson, and Hamilton as provided 'E>y applicable <br />Nebraska Law for each individual county to create and maintain its own local land use plan as above <br />described. <br />
