<br />~19g905()4 <br /> <br />NOW BE IT RESOLVED that pursuant to the Zoning Resolution of RaIl <br />County, Nebraska, the Hall County Board of Supervisors hereby authorizes the <br />conditional use of the above-described property for the storage in bulk of liquid <br />propane and fertilizer and for storage of propane and fertilizer tanks and equipment <br />related to the business operation of retail propane and fertilizer sales subject to the <br />following conditions: <br /> <br />1. The above described real estate shall be used solely for the storage in bulk of liquid <br />propane and fertilizer and for storage of propane and fertilizer tanks and equipment <br />related to the business operation of retail propane and fertilizer sales. The real estate <br />shall be enclosed by a wire mesh fence with suitable gates and locks thereon to <br />prevent access by unauthorized persons. The premises shall be maintained in a neat <br />and clean condition at all times, free of debris and inflammable waste materials. <br /> <br />2. Applicant shall comply with the Hall County Zoning Resolution and Hall County <br />Building Codes with respect to the use of the above-described property. <br /> <br />3. The rights and privileges granted herein may be terminated for any act or acts on <br />noncompliance with the terms and conditions of this resolution. The Hall County <br /> <br />Board of Supervisors shall provide written notice to Applicant of any act or acts <br />constituting noncompliance. Applicant shall have 14 days to cure such <br />noncompliance. In the event Applicant fails to cure such noncompliance, the RaIl <br />County Board of Supervisors may terminate or revoke the rights and privileges <br />granted herein. <br /> <br />4. Said propane and fertilizer shall be stored, placed, and maintained in accordance <br />with the rules and regulations promulgated by the Nebraska State Fire Marshal, the <br />Nebraska Department of Environmental Quality, and with all Federal, State and local <br />laws, rules, and regulations concerning such storage. <br /> <br />5. Nothing in this resolution shall be construed as a grant of right, authority, or <br />privilege to permit or allow any use of land, equipment, materials or methods which <br />violate any State or Federal law or any rule or regulation of any State or Federal <br />Administrative Agency. <br /> <br />6. The acceptance by Applicant of any benefit or right pursuant to this resolution shall <br />constitute Applicant's agreement to be bound by the terms, conditions, and restrictions <br />of this resolution. <br /> <br />7. The rights, privileges, and obligations granted by this resolution shall not be <br />assigned or transferred without the written consent of the County of Rall, Nebraska. <br /> <br />8.
