<br />F19990294 <br /> <br />RESOLUTION#~5l <br /> <br />WHEREAS, the County of Hall, State of Nebraska, is desirous of obtaining additional. '. <br /> <br />property for highway improvement purposes; and <br /> <br />WHEREAS, the County of Hall, State of Nebraska, has successfully negotiated with <br /> <br />Leonard L & Lorraine K Boltz, for the sale of certain real estate to be described in the following and: <br /> <br />WHEREAS, the County of Hall, State of Nebraska, is empowered by the Constitution <br /> <br />and laws of the State of Nebraska to purchase real estate for highway improvement purposes and <br /> <br />accept deeds conveying that real estate. <br /> <br />NOW, THEREFORE BE IT RESOLVED BY THE HALL COUNfY BOARD OF <br /> <br />SUPERVISORS, Hall County, State of Nebraska, to accept on behalf of Hall County, grantee, a <br /> <br />warranty deed from Leonard L & Lorraine K Boltz, grantor, to the following described real <br /> <br />estate: <br /> <br />A tract of land comprising a part of the Northeast Quarter (NE1/4) of Section Thirty One (31), Township <br />Twelve (12) North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska, and more particularly <br />described as follows: <br /> <br />First to ascertain the point of beginning, start at the northeast comer of said Northeast Quarter (NE1/4); <br />thence running southerly, along and upon the east line of said Northeast Quarter (NE1/4), a distance of <br />Five Hundred Ninety Three and Forty Six Hundredths (593.46) feet to a point on the southwesterly right <br />of way line of the Burlington Northern Santa Fe Railroad; thence deflecting right 106 31 '09" and running <br />northwesterly, along and upon said southwesterly railroad right of way line, a distance of Thirty Four and <br />Forty Two Hundredths (34.42) feet to a point on the westerly right of way line of 70th Road, said point <br />being Thirty Three (33.0) feet west of (measured perpendicularly to) the east line of said Northeast <br />Quarter (NE1/4); thence deflecting left 106 31 '09" and running southerly, along and upon said westerly <br />70th Road right of way line, a distance of Fifty Two and Fifteen Hundredths (52.15) feet to a point which <br />is Fifty (50.0) feet southwesterly of (measured perpendicularly to) said southwesterly railroad right of way <br />line, said point also being the ACTUAL point of beginning; thence continuing southerly, along and upon <br />the last described course, a distance of Fifty Two and Eighteen Hundredths (52.18) feet; thence deflecting <br />right 73 28'00" and running northwesterly, along and upon said westerly 70th Road right of way, a <br />distance of Seven and Three Tenths (7.30) feet to a point, said point being Forty (40.0) feet west of <br />(measured perpendicularly to ) the east line of said Northeast Quarter (NE1/4); thence deflecting left 106 <br />32'00" and running southerly, along and upon said westerly 70th Read right of way line, a distance of <br />Four Hundred Twenty Two and Seventeen Hundredths (422.17) feet; thence deflecting right 90 00'00" <br />and running westerly, a distance of Thirty (30.0) feet; thence deflecting right 90 00'00" and running <br />northerly, parallel with and Seventy (70.0) feet west of (measured perpendicularly to) the east line of said <br />Northeast Quarter (NE 1/4) a distance of Three Hundred Eighty One and Seventy Nine Hundredths <br />(381.79) feet; thence deflecting left 90 00'00" and running westerly, a distance ofTen (10.0) feet to a <br />point of curvature; thence running northwesterly, along and upon the arc of a curve to the right whose <br />radius is 309.11 feet, a distance of Two Hundred Seventeen and Fifty Four Hundredths (217.54) feet (long <br /> <br />.. <br />
