Mr. Quandt questioned if someone e wanted to build on the property what would happen. It was <br /> clarified that you cannot build unless there is a public access road. So if they wanted to build <br /> the road would have ta be opened and maintained. <br /> Mr. Johnson stated he is not planning to build on his property but he may in the future. Then <br /> the road would have to be upgraded or he would have to have a deeded right af way to the <br /> highway. <br /> Mr. Arnold stated that he understands if it is closed it would be difficult far future boards to come <br /> back and op�n it. Mr. Sherlock explained that this is a trail and below a minimum maintenance <br /> road. It would have to be upgraded if someane wanted to build. <br /> Mr. Johnson noted he may not be able to build and there is na reason for anyane to be down <br /> there it is a dead end road. Mr. Amick noted that he would have to upgrade the road to build. <br /> Lancaster questioned how this was different from the Uden property. Mr. Sherlock stated that <br /> that road was a minimum maintenance road and it was open. <br /> Mr. Quandt questioned if it is closed and the gate is put up could the county stipulate that the <br /> rural fire departments be allowed access. This would have to be stipulated in the resolution. He <br /> noted problems with a road that was closed on the Buffalo County line. <br /> Chairman Lancaster stated that they were allawed 13 minutes so Mr. Adam wilf be allowed the <br /> same. <br /> Jordan Adam, Attorney with Fraser Stryker Law Firm, Omaha, Nebraska was present on behalf <br /> of Crane Trust. He distributed informatian to the board members. The pointed out the Iocation <br /> of the road and provided photos of the area. There are 22 acres of wetlands and he pointed out <br /> the ground photos of the road and the gate. On the west side of the gate there is no raad just a <br /> trail, na power or telephone lines. He read the statute that would allow negotiations and the <br /> County could place stipulations on the agreement. They are requesting to not remov� the gate <br /> and to release the easement on the west side of the gate it is not needed. <br /> Arnold questioned why we would release the easement there is no harm in leaving it. Mr Adam <br /> noted that it does not serve a purpose and noted tab 9 in the hand outs and noted 39-1725 <br /> regarding the right of way and the fact that the statute allows the county to put on the conditians <br /> from the negotiations. Arnold stated that it would be hard far the county to come back and <br /> change it in the future. <br /> Mr. Schuppan stated this will affect future boards. <br /> Mr. Quandt noted that the Sheriff departments stated this is a problem area and Mr. Schuppan <br /> stated these types of problems are an issue in many places in the county. <br /> Chairman Lancaster called for public participation. <br /> Dr. Mary Harner, 6611 Wood River Drive requested to speak. She is a bialogist and stated that <br /> this is the largest track of wetland habitat and they use this as a reference for other wetland <br /> areas. The island is used by the whooping cranes and sand hills cranes their goal is to maintain <br /> the area and make it attractive to the cranes.
