COUNTY ATTORNEY-� CONSIDERATION AND POSSIBL� APPROVAL OF PROPOS�D <br /> SETTLEMENT O� CONDEMNATION PROCEEDINGS BETWEEN THE COUNTY OF HALL <br /> AND ADDREN "JOHN° ELLIS, ET AL., AND LITTLE E EAGLE, ET AL. — Deputy County <br /> Attorney Jack Zitterkopf stated that this matter has been discussed long before he started with <br /> the board and has been a big part of his life this last week. A settlement proposal was <br /> discussed in executive session and he sent a letter to oppasing counsel and he s�nt a reply <br /> back. He read the letter that was included in the packets noted that there were 2 minor chang�s <br /> that were addressed; the easement would decrease to 24 feet wide for the cattle shed that is <br /> lacated there and an issue with the current gate that would be used for livestock that would be <br /> left open and if closed it would be removed. This is an agreement to agree and there will b� an <br /> official settlement prepared. This agreement will be recorded with the register of deeds ta bind <br /> the parties. The surveying for the easement will be completed, the gate installed and he will <br /> come back with a formal settlement agreament for the board to make the final decision. <br /> Ziala noted that there may be comments from a rural fire department. They want to know if they <br /> will have access to this gat� in the ev�nt of a fire. Mr. Schuppan noted that 911 may be able to <br /> maintain the access code to the gate. <br /> Gregg Robb, Vice President af Rural Fire District#6 stated that the current gate is Iocked and <br /> they may need access to the building sites, but if they could have the cade it would wark. <br /> Mr. Ziola questioned who would install the gate and maintain it. <br /> Mr. Zitterkopf stated that the gate is a private gate. He does not see a problem with the fire <br /> department having access to the code if needed. <br /> Mr. Quandt questioned the cost involved. Mr. Sherlock stated that ther� is $40,000.00 in escrow <br /> that will be returned to the taxpayers and the cost of the gate would be about $10,000.00. If <br /> they install it themselves it may be around $5,000.00 but he would recommend having the gat� <br /> installed by a professional so that the codes will work. <br /> Mr. 5chuppan stat�d he talked to Mr. Ellis and they will let the gate open on his praperty. This <br /> is a solution ta an old problem. <br /> Mr. McFarland questioned if the verbal agreements would be written into the farmal agreement <br /> 3 <br />
