<br />THE ESTATE OF ) FINAL DECREE.

<br />STATE OF NEBRASKA ) At a session of the County Court held in and for said County of Hall
<br />COUNTY OF HALL )ss• and State of Nebraska, this 27th day of March, 1946,
<br />Present: Charles Bossert, County Judge.
<br />BE IT REMEMBERED: That on the lst day of ga,rch, 1946, Otto Guenther, Executor of the estate of
<br />Mary Gehrt, deceased, filed in this Court his final account as such Executor and a petition praying
<br />that said account be allowed, for a decree of heirship, an order of distribution, a final settle-
<br />ment thereon and discharge.
<br />For these purposes, the 27th day of March, 1946, at 10 o'clock A.R. at the County Court Room
<br />in said County was assigned as the time and place for hearing said petition, examining and allow-
<br />ing said account; and it was ordered that notice of the pendency of said petition be given to all
<br />persons interested in said estate by publishing such notice in the Grand Island Independent, a
<br />legal newspaper printed in said County, for three weeks prior to said day of hearing, and it
<br />appears by proof on file that said notice was given as ordered by Court and that no objections to
<br />said final-account have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />That Mary Gehrt departed this life on the 15th day of September, 1945, at her home in Grand
<br />Island in Hall County, Nebraska, testate, and at the time of her death she was a resident of
<br />Hall County, Nebraska.
<br />That on the 20th day of September, 1945, Otto Guenther filed in this Court an instrument pur-
<br />porting ':o be the Last Will and Testament of said Mary Gehrt, deceased, wherein said petitioner
<br />was named Executor and a petition offering said Will for probate, and on the 20th day of September
<br />1945, an order of this Court was made therein assigning the 17th day of October, 1945, at 10 o'clock
<br />A.M. in the County Court Room in said County as the time and place for hearing said petition, prov-
<br />ing said Will and admitting the same to probate and ordering that notice of the pendency of said
<br />petition and hearing thereon be given to all persons interested in said matter by publishing said
<br />notice in the Grand Island Independent, a legal newspaper printed in said County, for three suc-
<br />cessive weeks prior to said day of hearing, and it appears by proof on file that notice of said
<br />order was so given.
<br />The Court further finds that on the 17th day of October, 1945, said instrument was proven
<br />allowed and admitted to probate as the Last Will and Testament of Mary Gehrt, deceased, which
<br />Last Will and Testament is in words as follows: -
<br />LAST WILL AND TESTAMENT
<br />I, Mary Gehrt, a widow, of Grand Island, Nebraska, do hereby make, publish and declare this
<br />my Last Will and Testament hereby revoking all former Wills by me made, in words as follows:
<br />I hereby appoint my son Otto Guenther Executor of this Will and direct him to pay all claims
<br />against my estate, expenses of my last illness and probating this Will and administering my estate
<br />out of my personal property: I have some life insurance which is payable to my daughter Mrs. Carolina
<br />Louise Smith, and it is my Will that she use the proceeds of the same in payment of my burial and
<br />if that be not sufficient, then my Executor is to pay the balance thereof from my personal property.
<br />All of my household goods, clothes, linens and all other personal effects, I give to my daughter
<br />Carolina Smith; but I provide that out of the same, she permit my daughter -in -law Carolyn Guenther
<br />to select a remembrance for herself, and that my said daughter give to each of my granddaughters
<br />therefrom, a rememberance of me.
<br />I hereby bequeath unto the adopted son of my deceased son George Guenther, whose name is Jack
<br />Screeve Guenther, the sum of Five Dollars, ($5-00) and no more, which sum is to be paid him out
<br />of my personal property. 4.
<br />All tools, including carpenter and garden tools, I hereby bequeath unto my son Otto- Guenther.
<br />All the rest, residue and remainder of my personal estate, after payment of all of the foregoing,
<br />I bequeath as follows: A one- fourth part to Geraldine'Gehrt of Denver, Colorado, who is the only
<br />daughter of my deceased son Joan Gehrt; an undivided one - fourth part to my son Otto Guenther; an
<br />undivided one- fourth part to my daughter Earolina._Srith and an undivided one - eighth part to my
<br />granddaughter Evelyn Fregeu and an undivided one - eighth part to my grandson Robert Rex Cummings,
<br />both of Denver, Colorado, they being the two children of my deceased daughter Doris Cummings.
