a <br />- E A 3 E M E N T - <br />KNOW ALL MEN BT THESE PRESENTS, that Jack D. Voss and Wilma <br />Voss, individually and as husband and wife, in consideration of one dollar <br />and other valuable consideration in hand paid, do hereby grant, bargain, <br />sell, convey and confirm unto Bernhard Voss and Wilhelmina Voss, as <br />joint tenants and not as tenants in common, an easement for roadway <br />purposes over and upon the easterly forty -eight feet (480 of the <br />following described real estate, situated in the Qbunty of Hall and <br />State of Nebraska, to -wit: <br />A tract of land consisting of a part of Lot Six (6) <br />Of the Voss Subdivision of part of the Southeast <br />Quarter of the Southwest Quarter (SEkSWf) and part of <br />the Southwest Quarter of the Southeast Quarter (SWJSEJ) <br />of Section Eleven (11), Township Eleven North (TllN), <br />Range Nine West (R9W), of the 6th P.M., Hall County, <br />Nebraska, more particularly described as follows: <br />First to ascertain the point of beginningg of said tract, <br />start at the southeast corner (SE. C.)•of said Lot Six <br />(6), running thence westerly along and upon the south line <br />of Lot Six (6) a distance of three hundred sixty -three and <br />five tenths feet (363.5) thence deflecting right ninety <br />degrees and no minutes (90 *OOt) and running northerly <br />a distance of two hundred twenty -nine and ninety -five <br />hundredths feet (229.951),,to the point of beginning. <br />Thence continuing in a northerly direction, to a point on <br />the southerly right of way line of U.S. Highway No. 30, <br />thence running southwesterly along said southerly right of <br />way line a distance of eighty -eight and seven - tenths feet <br />(88.7'); running thence southerly and parallel to the east <br />line of said tract a distance of three hundred thirty -six <br />and fifteen hundredths feet (336.151)e thence deflecting <br />left ninety degrees and no minutes (96.001) and running <br />easterly a distance of eighty -one feet.(81.09) to the <br />point of beginning, <br />said easterly forty -eight feet to be measured upon the south boundary <br />line of the above described real estate. <br />It being the intention of all partVgilieilkto, that in the <br />event of the death bf either of said grantee3 ¢tha.'entire easement <br />for roadway purpose$ herein granted and conveyed shall.vest.in the <br />surviving grantee. <br />It being the further intention of all parties hereto that by the <br />easement for roadway purposes herein granted and conveyed it shall be <br />lawful for said grantees, their assigns, their heirs, their agents and <br />servants,.and any other person or persons for the benefit and advantage <br />of them or the survivor of them at all times freely to pass and repass <br />on foot, or with animals, vehicfes loads or otherwise, and to grade, <br />surface with gravel or other material whether or not permanent, and <br />maintain a roadway over and uponwthe above described premises. <br />TO HAVE AND TO HOLD the above described, eaeement' for roadway <br />purposes, unto the said grantee as joint tenants and not as tenants <br />in common, and to their assigns, or to.the' heirs and assigns of the <br />Sin -Avor of them forever. <br />/3 <br />
