<br /> of Joseph Livingston, a.nd said �oseph Livingston was one and the same person as the test�.tor herein,

<br /> The �ourt finds tn�t the above described real estate passed and descended under the last will
<br /> and testa.ment of Joseph A. Livingston, deceased, to the widow, Anna J. Livingston, free and clear of
<br /> all liens and incumbrances whatsoever, and free from any charges or liens ar�d free from the satis-
<br /> faction of the paragraphs Third, Fourth and Fifth of said last will and testament of Joseph A. ,
<br /> Livingston, deceased. � .
<br />�� � IT IS, THEREFORE, ORDERED that the abov e real estate be, and the s�m,me is hereby, set aside to
<br /> Anna, J. Livingston, . devisee, free and cle�,r of all liens, charges and encumbrances whataoever.

<br /> At a session of the Coun�y Court held in and for County of Hall, S�ate of Nebraska, this 4th
<br /> day of August, 191�8.
<br /> Present : Charles Bossert, County Judge.
<br /> BE IT REMEMBERED that on the 6th day of July, 1948, Herbert F. Ma�er, Adm�niatrator of' the
<br /> estate of Mar�aretha Hensley, deceased, filed in thia Court his f inal account as such Administrator
<br /> and a petition praying that said account be allowed, for a decree of heriship, an order of diatri-
<br /> bution, a determination of inheritance taxes, a final settlement thereon and discharge.
<br /> For these purposes, the 4th ��day of August, 1948, at 10 a� clock A.M. , at the Couzit,� Court Room
<br /> in said County was assigned as the time and place for hearin� said petition, examining and allowing -
<br /> said account ; and it was ordered that notice of the pendency of said petition be �iven tra a11
<br /> persons interested in said estate by publishing such notice in th� Grand Island Indepenc�ent, a
<br /> legal newspaper printed in said County, for three weeks prior to said day of hearing; and it appears
<br /> by proof on file that said notice tiJas given as ordered by Court and that no ob�eetions �o said
<br /> final account have been made or filed. .
<br /> Upon examination of the record and the evidence in th�s ma�ter and bein� duly advised in the
<br /> premises, the Court finds as follows: .
<br /> FIRST.
<br /> That Margaretha Hensley departed this life on the 28th d�.y of January, 194�3, in Grand Island,
<br /> Hall County, Nebra.ska, intestate,. and at the time of her death, she was a resident of Hall County,
<br /> Nebraska.
<br /> SECOND. •
<br /> That on the 31st day of January, 191�8, Orlando L. Henaley, son of said M�rgaretha He nsley,
<br /> deceased, filed in this Court a petition prayin� for the appointment of Herbert �. Mayer as Admin-
<br /> ist�ator of the estate of sa.id deceased, and on the 31st day of January, 194�8, an order of this
<br /> Court �aas made therein, assigning the 25th day of February, 19�8, at 10 o� clack a,t the County Court
<br /> Room in aaid County, as the time and place for hearing said petition, and ordering that notice of
<br /> the pendency of said petition and hearing thereon be given to all persons intereated in said matter
