<br /> This cause coming on for hearin� on the 20�h day of May, 194�, upon the petition of Glenn E.
<br /> Whitehead and Ha2e1 Whitehea.d, praying that the Court may find and determine the time of the death
<br /> oP the said Mary J. Cornwell and who the heirs-at-law of the said Mary J. Cornwell were at the
<br /> time of her death, the degree of kinship �.nd the right of descent oY the real estate in said
<br /> petition described. Testimony w�s taken and the matter submitted to the Court Por decree, and the
<br /> Court being fully advised in the premises, finds:
<br /> l.
<br /> That the Court has heretoPore fixed the time Por hearing on said petition and that notice of the
<br /> time and place of hear3.ng was duly given to all persons interested in said estate as required by
<br /> law, and the Court now has full ,�urisdiction to hear and determine said matter, and the Court
<br /> further finds that the said Mary J. Cornwell departed this liPe intesta�e at Rochester,
<br /> Minnesota, on the 20th day of March, 1923, while temporarily confined in a hospital there, and that
<br /> at the time of her death she was a resident of LincoI.n County, Nebraska.
<br /> 2.
<br /> The Court further finds that the decedent died intestate seized in fee eimple oP an estate of
<br /> inheritance in the St�.te of Nebraska and that at the time of her death, said decedent was seiZed
<br /> in fee simple of the following described real estate, to-wit : An undivided one-fifth interest in
<br /> and to Lot Four �4) in Block On� Hundred Ten (110) in Ra.ilroad Addition to the City of Grand Island,
<br /> Nebraska, in Hall County, Nebraska,
<br /> The Court Purther fincls that more than� two
<br /> years have elapsed since the death of the said
<br /> Mary J. Cornwell, a.nd that no application has been made in the State of Nebraska, Por the
<br /> app0�intment of an Administrator of her estate either by her heirs or persons claiming to be
<br /> creditors of said deceased; that no Administrator has been appoir�ted Por her estate in the State
<br /> of Nebr�.ska; that said estate is not sub,ject to inheritance tax; th�t the petitioners are the
<br /> owners of the real estate hereinabove described, having acquired title thereto by mea.ne
<br /> conveyances.
<br /> 4.
<br /> That the said r4�ry J. Cornwell, deceased, left her surviving as her sole and only heirs-at-law,
<br /> the Pollowing named persons, to-wit:
<br /> Charlea� J. Cornwell, her husband,
<br /> Asa D. Cornwell, her son,
<br /> Edward Cornwell, her son,
<br /> Frank Cornwell, her son,
<br /> Walter Cornwell, her son, and
<br /> Gladys Cornwell, her dau ghter
<br /> all of whom were over the age of 21 years at the time of the death of said ��ary J. Cornwell,
<br /> deceased and that title to the undivided 1/5 interest in and to Lot Four ( 4) in Block One Hundred
<br /> Ten (110� in Railroad Addi�ion to the City of Grand Island, �n Ha.11 County, Nebraska, descended to
<br /> and vested in the above-named heirs of sald deceased.
<br /> IT IS THERFFORE, ORDERED, ADJUDGED AiVD DECRFED B`.f THE COURT that the sa.id Mary J. Cornwell
<br /> I departed this life intestate more than two years prior to the filing of the petition herein, to-wit:
<br /> On the 20'�h day of Mareh, 192j, and that she left her surviving as her sole and only heirs-at-law,
<br /> � tl�e fol�.o��ring named persons, to-wit : Charles J. Cornwell, her husband, Asa D. Cornwell, her s on,
<br /> E�.iwa.rd Cornwell, her son, Frank Cornwell, her son, Walter Cornwell, her son and Gladys Cornwell,
<br /> her a�aughter, and by reason of the premises, fee simnle title to the real estate to-wit: An �'
<br /> undiv�ded one-fiPth interest in and to Lot Four (�+) in Block One Hundred Ten (110) in Ra.ilroad
<br /> Addition to the City of GrandIsland, Nebraska, in Hall County, Nebraska, descended to and vest�d
<br /> in the above-named heirs-at-law of the said Mary J. Cornwell, deceased.
