WILL AND DECREE RECORD <br />28081 —The Augustine Co., Grand Island, Nebr. <br />DECREE <br />IN THE COUNTY COURT OF HALL COUNTY,NUBRASKA <br />IN THE MATTER OF THE ESTATE OF ) <br />ESTATE NO.3967 <br />CORA J.EVANS,DECEASED ) DECREE <br />Now on this 6th day of September,1947,this matter came on to be heard upon the pleadings and the <br />evidence and was submitted to the Court, on consideration whereof the Court finds that due and <br />legal notice of these proceedings has been given to all persons interested in said matter,both <br />creditors and heirs as required by law,That all of the statements and allegations set forth in <br />the petition herein filed,are true;that said Cora J.Evans died intestate at Deadwood in Lawrence. <br />County,South Dakota,on June 26,1899,seized and possessed at the time of her death of Lot Six (6) <br />in Block Two (2) of Evans Addition to the City of Grand Island,Hall County,Nebraska.That no <br />application has been made in the State of Nebraska for the'appointment of an administrator of <br />the estate of said deceased; that' said Cora J. Evans left her surviving, her husband Fred T. Evans, <br />and two sons,Fred T.Evans,Jr.,and Joe S.Evans,and that her heirs and only heirs -at -law were and <br />are her said husband Fred T.Evans and her said children Fred T.Evans,Jr.,and Joe S.Evans;and <br />the Court hereby finds and determines that they are the sole and only heirs -at -law of said Cora <br />J.Evans,deceased,and that said real estate descended unto them and them only as the heirs -at -law <br />of said Cora J. Evans, deceased. <br />IT IS THEREFORE CONSIDERED AND ADJUDGED BY THE COURT that the real estate above described be and <br />the same is hereby assigned to the said Fred T.Evans,Fred T.Evans,Jr.,and Joe S.Evans,an undivided <br />one -third part to each of them. <br />IT IS FURTHER CONSIDERED AND ADJUDGED BY THE COURT that all claims and demands against the estate <br />of said Cora J.Evans,deceased,whether due or to bezome due,whether absolute or contingent,be and the <br />same hereby are forever barred. <br />Charles Bossert <br />orin y Judge <br />In the County Court of Hall County,Nebraska <br />Certificate <br />STATE OF NEBRASKA, ) <br />)SS. I direct that my executor hereinafter named pay all expenses which I may owe at the time <br />of my death including expenses of last illness. I direct that my executor complete the marker <br />now on our cemetery lot. I desire that my executor make necessary funeral arrangements, the <br />funeral arranged however not to be extravagant. <br />2. I give devise and bequeath all property, both real and personal, of which I may die <br />possessed, to Carl Steuven and Edna Steuven, share and share alike. <br />3. In making the above bequests and devise, I have full possession of all my faculties. I <br />know of the existence of a number of aunts and uncles, they being half brothers and sisters of my <br />father. I know of the existance of all my cousins and the fact that some of my fathers relatives <br />are deceased. I have never been very close to them and I do not desire that any of my relatives <br />have any part of my property. This matter has been considered by me over some period of time and <br />particularly since the death of my brother, Carl Suhr, who passed away last July. <br />I have been acquainted with the two people I have made beneficiaries of this will for many <br />years; they have been tenants on my brother's farm for the last eight years. I have felt free to <br />stay with them any time, but I have arranged to pay them for any extended stays on a basis agree- <br />able to them. I am not indebted to them in any way nor have they at any time requested me to <br />give them anything. I have gone over the question of my will with my attorney on three different <br />occasions in the last thirty days, during which conferences neither of the devisees above mentioned <br />were present. <br />4. I request the Court to appoint The First National Bank of Grand Island, 11Nebraska, executor <br />of this, my last will and testament. <br />Annie Suhr <br />WITNESSES: <br />Harry Grimminger <br />Selma C.
