k' <br />WILL AND DECREE RECORD <br />20081 —The Augustine Co., Grand Island, Nebr. y, <br />WILL AND DECREE 11 <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />IN THE MATTER OF ) <br />THE ESTATE OF ) FINAL DECREE <br />ANTJE MAGDALENA HAACK, deceased ) <br />STATE OF NEBRASKA) <br />SS At a session of the County Court held in and for said County of <br />COUNTY OF HALL ) Hall in the State of Nebraska, this 13th day of August, 1947. <br />Present: Charles Bossert, County Judge. <br />BE IT REMEMBERED: That on the 18th day of July, 1947, Minnie Vo.80, Executrix of the Estate of <br />Antje Magdalena Haack, deceased, filed in this Court her final account as such Executrix and a <br />petition praying that said account be allowed, determination of heirship, inheritance taxes and <br />distribution of estate, a final settlement thereon and dis:c4arge <br />For these purposes the 13th day of August, 1947, at 10 o'clock A.M. at the County Court Room <br />in said County was assigned as the time and place for hearing said petition, examining and <br />allowing said account; and it was ordered that notice of the pendency of said petition be given to <br />all persons interested in said estate by publishing such notice in the Grand Island Independent, a <br />legal newspaper printed in said County, for three weeks prior to said day of hearing, and it <br />appears by proof on file that said notice was given as ordered by Court and that no objections to <br />said account have been made or filed. <br />Upon examination of the record and the evidence in this matter and being duly advised in the <br />premises, the Court finds as followw: <br />FIRST <br />That Antje Magdalena Haack departed this life on the 18th day of February, 1947, at Grand <br />Island, Hall County, Nebraska, testate, and at the time of her death she was a resident of Hall <br />County, Nebraska. <br />SECOND <br />That on the 24th day of February, 1947, Minnie Voss filed in this Court an instrument <br />purporting to be the Last Will and Testament of said Antje Magdalena Haack, deceased, wherein <br />said petitioner was named Executrix, and a petition offering said Will for probate, and on the <br />24th day of February, 1947, an order of this Court was made therein assigning the 20th day of <br />March, 1947, at 10 o'clock A.M. in the County Court Room in said County as the time and place for <br />hearing said petition, proving said Will and admitting the same to probate and ordering that <br />notice of the pendency of said petition and hearing thereon be given to all persons interested in <br />said matter by publishing said notice in the Grand Island, Independent, a legal newspaper printed <br />in said County, for three successive weeks prior to said day of hearing, and it appears by proof <br />on file that notice of said order was so given. <br />THIRD <br />The Court further finds that on the 20th day of March, 1947, said instrument was proven, <br />allowed and admitted to probate as the Last Will and Testament of said Antje Magdalena Haack, <br />deceased, which Last Will and Testament is in words as follows: <br />THE LAST WILL OF ANTJE MAGDALENA HAACK <br />I, Antje Magdalena Haack of Grand Island, make this my last will hereby revoking all former <br />Wills. <br />I appoint my daughter Mrs. Minnie Voss Executrix of this will and provide that she need give <br />no surety as such executrix. <br />To the City of Grand Island I give one hundred dollars for the perpetual upkeep of my <br />cemetery lot. <br />To my grandchildren and my great grandchildren of which there are seventeen now living, I <br />give five hundred dollars to be paid them by my executrix after the payment of all my just debts <br />and expense of my last illness. <br />All the rest, residue and remainder of my estate, be the same real estate or personal property, <br />I give and devise to my six children share and share alike, that is to Chris Haack, Amanda Barker, <br />Minnie Voss, Ernest Haack, John Haack and William Haack, and to their heirs forever. In the <br />event that such devisees cannot agree on the selling price of my real estate then my said daughter <br />Minnie shall fix the price at which it shall be sold. <br />Done at Grand Island this 2nd day of October, 1933. <br />Antje Magdalena Haack <br />The foregoing was at the date thereof signed sealed published and declared by said testatrix <br />as and for her last will in our presence and we in her presence and at her request have signed our <br />names as witnesses hereto. <br />and attached thereto is the following certificate: <br />STATE OF NEBRASKA) <br />2. <br />Margaret Miller, 721 No. Pine,Grand Island <br />Arthur C. Mayer <br />CERTIFICATE OF PROBATE OF WILL <br />SS At a session of the County Court held in the County Court Room in Grand <br />HALL COUNTY ) Island, in said County, on the 20th day of March, A.D. , 1947. <br />Present, Charles Bossert, <br />County Judge. <br />In the Matter of the Estate of Antje Magdalena Haack, deceased I, Charles Bossert, Judge of the <br />County Court, in and for said County, do hereby certify that on the 24th day of February, 1947, the <br />instrument purporting to be the last will and testament of Antje Magdalena Haack, deceased, was <br />filed for probate in this Court. That on the 20th day of March, 1947, said instrument to which this <br />certificate is attached was duly proved, probated and allowed as the last will and testament of <br />the real and personal estate of said Antje Magdalena Haack deceased, and the same was ordered to <br />be recorded in the records of the Court aforesaid. <br />In witness whereof, I have hereunto set my hand and affixed the seal of the County Court, this <br />20th day of March, 1947- Charles Bossert <br />(SEAL) County Judge. <br />1 <br />7 <br />
