Stout, Deceased. <br />Now on this 21st day of December, 1906, this being the adjourned day set for hearing upon the <br />petition of Alice A. Stout, administratrix of the estate of Henry W. Stout, deceased, praying for <br />the allowance of her account heretofore filed in this office for the assignment of the residue of <br />of said estate and for her discharge from said trust; and also for hearing upon the petition of the <br />said Alice A. Stout, praying this Court to assign her homestead to her out of the real estate be- <br />longing to said estate; and it appearing from the evidence before me that all persons interested <br />in this proceeding have had due and legal notice of this proceeding, and Helen Walley and Cecil C. <br />Stout, two of the heirs of said deceased having heretofore filed objections to the allowance of <br />the report of said administratrix, and all parties appearing in person and by their attorneys, and <br />the issues being before the Court, and the matter coming on to be heard upon the pleadings and the <br />evidence, the Court finds generally for the administratrix and against the objectors, except as <br />hereinafter stated. <br />The Court further finds: <br />First:- That on or about the 3rd day of February, 1903, the said Henry W. Stout died intestate <br />at his residence in Edgar:°, Clay County, Nebraska, leaving surviving him a widow named Alice A. Stout, <br />a son named Cecil C. Stout, a daughter named Helen V�. Walley now of lawful age and a son named <br />Leslie W. Stout a minor, and that about two months after the death of the said Henry W. Stout, there <br />was born to his widow by him, a son named Harold W. Stout, who are the only heirs at law and only <br />persons interested in his estate. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report of Ira <br />Hunsberger, executor of the estate of Sophia Fuehrer., deceased, be, and the same hereby is, in all <br />things, approved and allowed as and for the Final Report of said executor, and said estate is <br />hereby settled and closed and the executor discharged. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against <br />said estate, if any such there be, are forever barred, enjoined and excluded from setting up or <br />asserting any such claim against said estate. <br />,q%udyed <br />IT IS FURTHER O"ERED4AND DECREED BY THE COURT that all of the personal property remaining in - <br />the hands of the executor be distributed among the eight children hereinabove- named, and the real <br />estate described as Lot Six (6), Block Sixty -Nine (69), Wheeler & Bennett's Addition, did pass in <br />accordance with the provisions of the Last Will and Testament of the deceased to her eight children, <br />being her heirs -at -law hereinabove - named, and thgtt the real estate described as Lot Seven (7) Block <br />Sixty -Nine (69), Wheeler & Bennett's Second Addition to the City .of Grand Island, Hall County, <br />Nebraska, did pass under the provisions of said Will to the Salem Evangelical Church for the use <br />of said Church as the trustees thereof or the congregation, as the case may be, see fit, to have <br />and to hold the same forever. <br />Charles Bossert <br />County ,Judge. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />CERTIFICATE <br />STATE OF NEBRASKA) <br />ss. Stout, occupied as a homestead the following described <br />of, and together with <br />lot or parcel of ground in Edgar, more particularly described as follows:- Commencing on the <br />East side of �'A" street sixty feet East of the South -east corner of block one, thence running two <br />hundred feet East to half- section, line, thence North one hundred and fifty feet thence West two <br />hundred feet to East side of "A" street thence South one hundred and fifty feet to the place of <br />beginning, being a part of the South -west quarter of section twenty-six-in town five North of <br />range six West in Clay County, Nebraska, and upon which real estate the said Alice A. Stout has <br />continueously resided since the deat)i of said Henry W. Stout, deceased, and that the said Alice <br />A. Stout is entitled to have said real estate set off to her and the minor children of said <br />deceased as a homestead. <br />Third:- I further find that at the time of his death, the said Henry W. Stout was the owner of <br />lots six and seven in block nine in Wallich's addition to the City of Grand Island, Nebraska. <br />Fourth: - I further find that on or about the 11th day of March, 1903, the said Alice A.
