NO. 9 HALL COUNTY <br />WILL AND DECREE <br />t <br />LAST ?MILL AND TESTAMENT OF FRED BEBERNISS <br />IN THE NAME OF GOD, AMEN <br />I, Fred Beberniss, of the City of Grand, Hall County, Nebraska, considering the uncertainty <br />of this mortal life and being of sound mind and memory, do make, publish and declare this', as and <br />for my last Will and Testament, that is to say: <br />FIRST. <br />I direct that my funeral charges, the expenses of my last sickness, the expenses of adminis- <br />tering my estate, and all my just debts be paid out of my personal property, provided that there <br />is sufficient personal property to take care of these expenses. If that be insufficient,''it is <br />my wish and desire that my executor hereinafter named, shall sell and dispose of a certain note <br />given me by Agnes Winter in the amount of $1500.00 which note was secured byy a first mortgage on <br />the North half of the Northwest (NN'di) Quarter of Section Twenty -seven (27), Township Twelve (12) <br />North,Range Nine (9) West of the 6th P.M. in Hall County, Nebraska, which said note and mortgage <br />has been foreclosed in the District Court of Hall County, Nebraska, and a decree of foreclosure <br />entered. If any moneys remain after the payment of the foregoing it is my desire that the first <br />One Hundred ($100.00) Dollars I hereby give devise and bequeath to Herman Falmlen, the next Three <br />Hundred ($300.00) Dollars I give devise and bequeath to my son Fred Beberniss; the next Two Hun- <br />dred ($200.00) Dollars I give devise and bequeath to my son Walter Beberniss and any amount re- <br />bore <br />maining after the payment of said beauest I give devise and bequeath to Ida and Ellen <br />Weaver, share and share alike. <br />SECOND. <br />Having heretofore deeded to William - Hermann, Tusband of my deceased daughter, Alvina Hermann, <br />the West half of the Southwest (W�SWI) Quarter of Section Nine (9), Township Eighteen (19), Range <br />Eighteen (18) in Dewey County, Oklahoma, containing eighty acres, more or less, accordinglto the <br />government survey thereof, together with all and singular the tenements, hereditaments and appur- <br />tenances, unto the above mentioned and described premises belonging,to have and to hold forever, <br />I give him nothing hereunder for the reason that the aforesaid conveyance of said premises to him <br />In my life time constitutes the distributive share of his children and the children of my',deceased <br />daughter in my estate, the intention being that the aforementioned conveyance is to constitute the <br />distributive share of my said. grand - children in my estate. I have taken into consideration that <br />since the aforesaid conveyance the said William Hermann has passed away, but his children'shall <br />receive their fair share in his estate. <br />THIRD. <br />Having in my lifetime deeded to my daughter, Ida Poore, the following described premises: <br />Commencing on the South line of Block Eight -nine (89) Original Town, now city of Grand Island, <br />Hall County, Nebraska, at a point fifty (501 feet East of the Wouthwest corner of said block, <br />thence eighty -eight (98) feet in a Northwesterly direction and paralle to the line of the alley <br />in said block, One Hundred Fourteen (114) feet to the West line of the Couly road, now known <br />as Locust Street, thence South along the West line of said block sixty -five (65) feet to the <br />place of beginning; having deeded to her the Southerly Sixty (60� feet of said above described <br />premises, counting from the Southern extremity thereof on Locust Street and extending across said <br />premises to the Westerly limit thereof in a straight line; it is my order that the conveyance thus <br />made be construed as having been made in lieu of a part of her inheritance in my estate, and in <br />ad�.ition thereto I hereby give, devise and bequeath to my daughter, Ida Poore, an undivid d one - <br />half (112) of the West Thirty three (33) feet of Lot Four (4), Block One Hundred Four (10 ), Rail- <br />road Addition to the City of Grand Island, Hall County, Nebraska, which property is also described <br />as 423 West Koenig Street, Grand Island, Nebraska, to have and to hold to her and her heirs forever, <br />(the other undivided one half of said property I am hereinafter giving to my daughter Ellen Weaver).' <br />FOURTH <br />Having in my life time transferred and deed--- to my daughter, Ellen Weaver, <br />the no_Ntherly forty ( 40 ) feet, more or less, counting from the South to the North and extending <br />straight across, said remises of the following described premises; Commencing on the South line of <br />Block eighty -nine (89 of the Original ToiAm, now City of Grand Island, Hall County, Nebraska, at <br />a point fifty (50) feet East of the Southwest corner of said block, thence running eightyteight <br />(98) feet in a northwesterly direction, and parallel to the West line of the said block, thence <br />in a northeasterly direction and parallel to the line of the alley in said block, one hundred <br />fourteen (114) feet to the West line of the_ County road, now known as Locust Street, thence <br />South along the West line of said County road one hundred (100) feet to the South line oflsaid <br />block, thence in a Southwesterly direction along the South line of said block sixty -five (65) <br />feet to the place of beginning, the same having a frontage on Locust Street of Forty (40)I, feet. <br />It is my order that the conveyance thus made be construed as having been made in lieu of part <br />of her inheritance in my estate and in addition thereto, I hereby give, devise and bequea�h to <br />my daughter, Ellen Weaver, the f- llowing described premises: All of Lot Two (2) of County Sub- <br />division of the West Half (W -z) of the southwest (5,, &) Quarter of Section TOn, (10), Township <br />Eleven (11) North,Range Nine (9) West of the 6th P.M. in Hall County, Nebraska, otherwise known <br />as 901 East Sixth Street, Grand Island, Nebraska, to have and to hold to her heirs forever; that <br />In addition thereto I further give, devise and bequeath to my daughter, Ellen Weaver, thelfollow- <br />ing described premises; An undivided one -half (112) interest in the Westerly Thirty- threei(33) <br />feet of Lot Four (4) Block One Hundred Four (104),Railroad Addition to the City of Grand Island, <br />Hall County, Nebraska, which property is also described as 423 West Koenig Street, Grand Tsl nd, <br />Nebraska, to have and to hold to her and her heirs forever, (the other undivided one- half'ift 2) <br />of said property I have hereto willed to my daughter, Ida Poore). <br />FIFTH. <br />I give, devise and bequeath to my son, Walter Beberniss, the West Half of Lot Seven (7), <br />Block Twenty -six (26) of the Original Town, now city of Grand Island, Hall County, Nebraska, <br />otherwise known as 514 East Fourth Street, Grand Island, Nebraska, to have and to hold to 'shim <br />and. his heirs forever; that in addition to this I further give, devise and bequeath to mylsaid <br />' <br />son, Walter Beberniss, the Two Hundred ($200.00) Dollars provided for in Paragraph One hereof, <br />provided there is sufficient money to pay the same. <br />SIXTH <br />I Give,devise and bequeath unto my son, Fred the Easterly Thirty -three (33)'f eet <br />to the City Grand Island, Hall <br />of Lot Four (4), Block One Hundred Four (104) Railroad Addition of <br />County, Nebraska, also known as 419 'hest Koenig Street, Grand Island, Nebraska, to have and to <br />hold to him and his heirs forever, (This tract being a rectangular tract of land with a frontage <br />of Thirty -three (33) feet on Koenig Street and extending_ South.Eighty two (82) feet)*' That in <br />addition to this II further give, devise and bequeath to my said son Fred Beberniss the Three <br />Hundred 0300.00) Dollars provided for in paragraph one hereof, providing there is sufficient <br />money to pp.y the same. <br />
