<br />20081 —The Augustine Co., Grand Island, Nebr.
<br />be assigned to Nona J.Falmlen, widow, of said testator, for life, with remainder over to the heirs
<br />at law of said testator as provided in the last will and testament of said testator; that the balance
<br />of the personal property now in the hands of said Executrix be and the same is hereby assigned to
<br />Nona J.Falmlen, widow of said testator, to be hers absolutely; that upon the filing of a proper
<br />receipt evidencing the delivery and payment of the balance of the personal property, said Executrix
<br />herein shall be entitled to be discharged from her trust and that she and the surety on her official
<br />bond shall be released-from all liability-thereon.
<br />IT IS FURTHER ORDERED that the matter of the discharge-of said Executrix be continued until the
<br />further order of this court and that said Nona J.Falmlen be retained and continued as Executrix
<br />herein until her discharge is entered of record herein.
<br />This cause then came on further to be heard on said day and it appearing to the satisfaction of
<br />the court that said Executrix has delivered all the personal property in this estate to herself as
<br />sole legatee and filed her receipt for the same and it furthe--, appearing to the satisfaction of the
<br />court that an Executrix' bond of $100.00 will be sufficient henceforth until the Executrix herein
<br />is discharged, and that said Executrix has tendered and filed a new bond herein in the amount of
<br />$100.00 with qualified surety,
<br />IT IS THEREFORE ORDERED that the surety on the original Executrix' bond be and it is hereby re-
<br />leased from all liabilit thereon.

<br />that I have the legal custody and control of said original record; that said Court is a court of
<br />record, has a seal, and that said seal is hereto affixed; and that the foregoing attestation is in
<br />due form, according to the laws of the State of Nebraska.

<br />I. J.A.Angier, County Judge in and for the County of Sherman and State of Nebraska,-do hereby
<br />certify that in the matter of the estate of Charles Herman Gasteyer, Deceased, in the office of the
<br />County Court of said County, the following among other things show in the probate records of said
<br />office, to-wit:-
<br />That on the 5th day of June, 1904, a petition was-filed in said Court by one Blanche May.Gasteyer,
<br />Widow of said deceased, praying for the probate-of the last Will and Testament of said Charles
<br />Kerman Gasteyer, Deceased, and for the appointment of an executor of said estate, and at the same
<br />time filing a package purporting to be the last Will and Testament of said Charles Herman Gasteyer,
<br />Deceased.
<br />That a day 2Cor hearing upon said petition was by the Court fixed, and that notice of such day of
<br />hearing, was given by publication for three - consecutive weeks in the Sherman County Times Indepen-
<br />dent, a weekly newspaper published in said County, and of general circulation therein;
<br />That a hearing was had in said matter upon the day fixed by the Court, and the last Will and Testa-
<br />ment of said Charles Herman Gasteyer, Deceased, which is as follows, was duly admitted to probate
<br />as and for the last Will and Testament of said deceased; to- wit:
<br />Copy of last Will and Testament of Charles Herman Gasteyer, dec.
<br />I, Charles Herman Gasteyer, of Loup City, in the County of Sherman, and State of Nebraska, being
<br />of sound mind and memory, do hereby publish and declare this to be my last Will and Testament,
<br />that is to say:
<br />First.
<br />I will that all my just debts and funeral expenses be paid by my executrix hereinafter named.
<br />Second.
<br />I give devise and bequeath, all my property both Re4l and Personal, wherever,situate, of which I
<br />may die seized, to my wife Blanche May Gasteyer, to her and her heirs and assigns forever.
<br />Third. -
<br />I hereby appoint my said wife Blanche May Gasteyer, the sole executrix of this my last Will and
<br />Testament.
<br />In Witness Whereof, I have hereunto set my hand at Omaha, Nebraska, this Fifteenth day of March,
<br />Nineteen Hundred and Two.

<br />as and for his last Will and Testament, in the presence of us, who in his presence and in the
<br />presence of each other and at his request have hereunto subscribed our names as witnesses.

<br />That the said Blanche May Gasteter, gave bond and took the oath of office as required by law, and
<br />that Letters Testamentary were by the Court Duly issued to her.
<br />That a day was fixed by the Court for the examining and allowing of claims against said estate,
<br />and also limiting the time in which claims could be filed against said estate, and that a notice
<br />of the same was given to the creditors of said estate by publication for four consecutive weeks
<br />in the Sherman County Times Independent, and also by posting in four public places copies of said
<br />notice, in said County, as the law requires.
<br />That a hearing was had upon the day set for the examining of claims filed against said estate,
<br />and it was found that there had been no claims filed against said estate, and the time for the
<br />filing of claims against the estate of said Charles Herman Gasteyer, Deceased was by the order of
<br />the Court declared closed.
