I,Charles Bossert County Judge of Hall County,Nebraska,do hereby <br />Hall County ) certify that I have compared the foregoing copy of Decree entered <br />IN THE MATTER OF THE ESTATE OF ERNEST COONS,DECEASED, with the original <br />record thereof,now remaining in said Court,that the same is*a correct transcript thereof,and of <br />the whole of such original record ;that said Court is a Court of Record having a seal,which seal <br />is hereto attached ;tha.t said Court has no Clerk authorized to sign certificates in his own name, <br />and that I am the legal custodian of said Seal and of the Records of said Court,and that the <br />foregoing attestation is in due form of law. <br />IN TESTIMONY WHEREOF,I have hereunto set my hand and affixed the seal of the County Court,at <br />Grand Island, this 6th day of March 1946. <br />_(SEAL) Charles Bossert <br />County Judge <br />Filed for record this 6 day of March,1946,at 4 o'clock P.M. <br />Register of Deeds <br />- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o -o -o -o <br />WILL AND DECREE <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA <br />IN THE MATTER OF ) <br />THE ESTATE OF ) FINAL DECREE. <br />MINNIE LESCHINSKY, deceased. ) <br />STATE OF NEBRASKA ) <br />COUNTY OF HALL )ss- At a session of the County Court held in and for said County,of Hall, <br />State of Nebraska, this 6th day of March, 1946, <br />Present: Charles Bossert, County Judge. <br />BE IT REMEMBERED, that on the 6th day of February, 1946, Elizabeth Doll, Executrix of the <br />estate of Minnie Leschinsky, deceased, filed in this Court her final account as such Executrix <br />and a petition praying that said account be allowed, for a- decree of heirship, an order of dis- <br />tribution, a final settlement thereon and discharge. <br />For these purposes, the 6th day of March, 1946, at 10 o'clock A.M. at the County Court Room in <br />said County was assigned as the time and place for hearing said petition, ekamining and allowing <br />said account; and is was ordered that notice of the pendency of said petition be given to all <br />persons interested in said estate, by publishing such notice in the Grand Island Independent, a <br />legal newspaper printed in said County, for three weeks prior to said day of hearing; and it <br />appears by proof on file that said notice was given as ordered by Court and that no objections to <br />said final account have been made or filed." <br />Upon examination of the record and the evidence in this natter and being duly advised in the <br />premises, the Court finds as follows: <br />FIRST. <br />That Minnie Leschinsky departed this life on the 20th day of August, 1945, at her home in <br />Grand Island, Hall County, Nebraska, testate, and at the.time of her death she was a resident <br />of Hall County, Nebraska. <br />SECOND. <br />That on the 25th day of August, 1945, Elizabeth Doll filed in this Court instruments purporting <br />to be the Last Will and Testament and Codicil thereto of the said Minnie Leschinsky, deceased, <br />wherein the said petitioner was named Executrix, and a petition offering said Will and Codicil for <br />probate, alleging that said Minnie Leschinsky departed this life on August 20, 1945, in Grand Island <br />Hall County, Nebraska, and on the 25th day of August, 1945, an order of this Court was made therein <br />assigning the 19th day of September, 1945, at 10 o'clock A.M. in the County Court Room in said County <br />as the time and place for hearing said petition, proving said Will and Codicil thereto, and admitting <br />the same to probate and ordering that notice of the �)endency of said petition and hearing thereon <br />be given to all persons interested in said matter by publishing said notice in the Grand Island In- <br />dependent, a legal newspaper printed in said County, for three successive weeks prior to said day <br />of hearing, and it appears by proof on file that notice of said order was so given. <br />THIRD. <br />The Court further finds that on the 19th day of September, 1945, said instruments were proven, <br />allowed and admitted to probate as the Last Will and Testament and Codicil thereto of the said <br />Minnie Leschinsky, deceased, which Last Will and Testament, and Codicil thereto, are in words as <br />follows: <br />The Last Will of Minnie Leschinsky <br />I, Minnie Leschinsky, of Grand Island, Nebraska, hereby make this my Last Will, revoking all <br />former Wills by me made. <br />It is my wish that I be buried upon my family lot in the Grand Island Cemetery and my grave <br />be marked with a headstone similar to the one placed on my husband's grave. The headstone shall <br />be put in place within one year after my decease. <br />I hereby appoint my sister Miss Elizabeth Doll of Grand Island, Nebraska, executrix of this <br />Will and provide that she need give no surety upon any bond required from her <br />I am indebted to my said sister in the sum of Three Thousand Dollars 03,000.00), evidenced by my <br />promissory note, and it is my Will that said sum be treated as a claim against my estate and paid <br />to her the same as any other claim. Should the Statute of Limitations have run against said claim, <br />then this Will shall be treated as a written acknowledgment of the debt staying the running of the <br />Statute. <br />Any debts ownig..me at the time of my decease, be they promissory notes secured by real estate <br />mortgage or unsecured, or any other debts which my sisters,Mifs: Anna Lumbard or Miss Elizabeth <br />Doll, might oTae me, shall be cancelled and I hereby give to such debtors the amount they may be <br />owing to me at the time of my decease. <br />All the rest, residue and remainder, be the same real estate, personal property or mixed property <br />of every kind and description, I hereby give, devise and bequeath unto my said sisters Anna Lumbard <br />and Elizabeth Doll, to them as joint tenants, the intention being that in the event of the death of <br />either of said devisees, the entire fee simple title to the real estate herein devised shall vest <br />in the surviving devisee, such survivor and her heirs and assigns forever. <br />I have made no provision fbr any of the relatives of my deceased husband as I feel under no <br />obligations to them. <br />It is my wish and desire that this Will be probated and my estate administered by the law firm <br />of Mayer & Mayer, or either one of them, with whom I have discussed the provisions of this Will <br />1 <br />�J <br />1 <br />1 <br />
