<br />of the said Peter M. Peterson by operation of law to the following named heirs -at -law, as
<br />follows : - To Augusta L. Peterson, surviving widow, an undivided one -third interest therein, anc
<br />to Pauline S. Peterson, Frieda Peterson Erdbruger, Edna Peterson Clampitt, Fred C. Peterson and
<br />Rudolph Peterson each an undivided two: - fifteenth interest therein, subject to the homestead
<br />estate therein, which passed and descended by operation of law to Augusta L. Peterson, surviving"
<br />widow of said deceased.
<br />The Court further finds that no petition or application has been filed in the State of NebTas.r
<br />ka for the appointment of an administrator of the estate of said deceased, and that no admin- j
<br />istration has been had upon his estate in the State of Nebraska, and that more than two years
<br />have elapsed since his death; that he died intestate; that his funeral expenses have been paid,
<br />and that all the debts of said deceased, and his estate, have been paid and are forever barred
<br />and precluded, and that the costs of this proceeding have been paid.
<br />The Court further finds that the petitioner, Augusta L. Peterson, is the owner by fee simple
<br />title of an undivided one -third interest in the real estate hereinbefore described, and duly ii
<br />authorized by law to make this application in this Court.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the said Peter M. Peterson
<br />died intestate as above stated, more than two years prior to the filing of the petition herein;
<br />that no application for the appointment of an Administrator of his estate has ever been made
<br />in the State of Nebraska or elsewhere, nor has there been any administration of his estate in
<br />the State of Nebraskaor elsewhere, and that he died seized in fee simple of the following
<br />described real estate, to -wit: Fractional Lot Five, in Block Ten, in Arnold & Abbott's Additic4i,
<br />and Fractional Lot Five, in Fractional Block Nineteen, in Rollin's Addition, all in Grand
<br />Island, Hall County, Nebraska; that he left surviving him as his sole and only heirs -at -law,
<br />the following named heirs, to -wit: Augusta L. Peterson, surviving widow, and Pauline S. Petereca ,

<br />a daughter, Frieda Peterson Erdbruger, a daughter, Edna Peterson Clampitt, a daughter, Fred-:C..

<br />Peterson, a son and Rudolph Peterson, a son; that the above described real estate passed and
<br />descended upon the death of the said Peter M. Peterson, by operation of law, to Augusta L. Pete-

<br />Erdbruger, Edna Peterson Clampitt, Fred C. Peterson and Rudolph Peterson each an undivided tw4j
