LITHOGRAPH I NG, STATIONERY; OMAHA <br />section No. 32, in Tp. 11, North of Range No. 12, also the southwest quarter of the southwest <br />quarter, of section No. 33, in Tp. 11, North of Range No. 12, West, all in Hall County, State of <br />Nebraska, to be for his own pro-per use conditioned upon his paying to the balance of the heirs <br />of the estate the principal sum of five hundred dollars, within five years from the time he <br />becomes into poss6ssion and full use of the same, said sum of five hundred dollars to be equally <br />divided between such heirs and said sum of five hundred dollars to draw interest at the rate of <br />six per cent per annum, payable annually. <br />Fourth . <br />The names of my heirs heretofore mentioned are as follows: Laura B. Ewing, Luett's,M. Renderer, <br />Ralph E. Dubbs, John H. Dubbs,, Elizabeth A. Holden, Mary M. Dubbs, Walter C. Dubbs, Marion F. Dubbs, <br />Raymond B. Dubbs, Emmet J. Dubbs, Florence I. Dubbs and Daniel Dubbs. The aforesaid heirs are <br />those Who are to share and share alike in the distribution of my estate, except Daniel Dubbs, who <br />is made provision for in the third section of this instrument. <br />Fifth : <br />I further direct that in case my beloved. wife, I'lary E. Dubbs should die before all of my said <br />heirs become twenty­�one years old that none of my real estate be sold or any division of the same <br />be done until the youngest living heir shall be twenty-one years old. In case any one of my said <br />children shall die before such division has been made of my estate leaving issue or descendants,, I <br />direct that his share shall not lapse but shall be paid to such descendants in equal proportions. <br />Sixth: <br />I further direct that in case my beloved wife should marry after my demise and before the young- <br />est living heir should become twenty-one years old and before any division of the estate, then and <br />in that case I direct that my said wife shall receive only the interests from any moneys or other <br />personal property then belonging to the estate and one third of the rent and profits of any real <br />estate belonging to the estate. <br />Seventh: <br />I further direct that my Executor or his successor as the case may be, shall make provision that <br />the homestead shall be used by the children who are unmarried and under 21 years of age as their <br />home until they respectively become 21 years old. <br />Eighth: <br />I appoint my son Ralph E. Dubbs, Executor of,this my last will and testament and in case of his <br />death before said estate is finally settled, I further direct that my son Walter C. Dubbs, shall be <br />his successor, and I further direct that no fee be paid to said Executor or executors, except the <br />actual per-diem and actual expenses incurred, and I further direct that in case any of my heirs shall <br />become separated from any cause so as not be considered husband and wife., as the case may be or <br />divorced one from the other before any issue, or offspring, by reason of such marriage relation <br />or should such heir die under such aforesaid circumstances., then and in that case such heirs <br />interest in my estate whatever the same may be., shall lapse, and not descend to any such offspring, <br />vridow or widower, as the case may be; but such widow or widower as the case may be, shall not be <br />deprived of any legal interest in my estate if death should occur before any issue, provided their <br />marriage relations, as to living together as husband and wife., have been maintained. <br />In Witness whereof I have hereunto subscribed my name this 11th day of July A.D. 1898. <br />William W. Dubbs, the testator, <br />subscribed his name to this instrument in our presence and in the presence of each of us, and <br />declared at the same time in our presence and hearing that this instrument was his last will and <br />testament, and we at his request sign our names hereto in his presence as attesting witnesses. <br />J.
