~~~_~'' ~#~+ DECLARATION OE ANNEXATION <br />Mid-Continent Enterprises, Inc., being the Declarant, does hereby <br />declare that the hereinafter described real estate is hereby annexed to <br />and shall hereafter be subject to the provisions of the Declaration <br />filed of record in the Office of the Register of Deeds of Nall County, <br />Nebraska, in Book 28 of Miscellaneous Records, at Page 604 through 620 <br />inclusive. This annexation is upon the fallowing terms and conditions: <br />{a) The annexed real estate is: Block Seven (7}, Unit One (1), <br />Continental Gardens, an addition to the City of Grand Island, <br />H-all Caunty, Nebraska, as surveyed, platted and recorded. <br />(b) The common area included therein is Outlot A of the said <br />Block Seven (7), Unit One (1), Continental Gardens, an addition <br />to the City of Grand Island, and said common area shall be <br />deeded to the Continental Gardens Homeowners Association, a non- <br />profit Nebraska corporation, simultaneously with the recording <br />of this Declaration of Annexation. <br />(c) The general restrictions which shall be imposed upon the <br />Lse of said annexed real estate are as follows: <br />(1} Ear-h lot in Block Seven (7), Unit One (1), Continental <br />Gardens, shall be generally limited and restricted in its <br />use as provided in this Article as well as being more <br />specifically restricted by the provisions of Article V of <br />the original declaration, beginning at Page 608 in Book 28 <br />of Miscellaneous Records in the Office of the Register of <br />Deeds of Hall County, Nebraska. <br />(2) No awnings or sun screens of any type shall be affixed <br />to any building or structure within the properties without <br />the written consent of the Association. <br />(3) No fences or enclosures of any type or nature whatsoever. <br />shall ever be constructed, erected, placed or maintained on <br />or about any lot within the properties except such fences <br />or enclosures as may be authorized by the Association. <br />(4) No truck, trailer, boat, motor home, camper equipment <br />or machinery or cars not in daily u5~ shall ever be parked, <br />located or otherwise maintained on any lot, parking area, <br />street or common area in the properties, except in cases <br />of emergency due to breakdown or accident. <br />(5} Resident's automobiles shall be parked only in garages <br />or driveways, <br />(6) No garbage cans, wood piles, or clotheslines or clothes <br />hangers may be placed upon any lot, constructed or used unless <br />they are located only by the private patio or garden area <br />approved by the Association under paragraph 3 of Article V <br />of the original Declaration filed in Book 28 of Miscellaneous <br />Records in the Office of the Register of-Deeds bf Hall County, <br />Nebraska. <br />- 1 - <br />
