DOUTHIT AND DONNA M. DOUTHIT, hereinafter referred to as the "Licensee". 1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the following described improvement which will infringe upon the public right-of way; To place a private discharge pipe in the public right-of--way immediately to the west of Ando Avenue, in front of 1.602, 1606 and 1608 Ando Avenue (Lots 1, 2 and 3 all in Block S of Kay-Dee Subdivision) for the discharge of groundwater directly to a storm drainage area inlet. This private line must meet all code clearances especially when crossing water mains. The water main must be crossed at a 90° angle using either C900 or C905 plastic pipe. The public sanitary sewer and public storm drainage pipes are in the same easement at the Barbara Avenue and Ando Avenue intersection. The Licensee will be responsible for restoring the surface to the same condition it was in prior to the work being done. This license agreement is solely for the permission to place a pipe in the right-of--way and a storm drainage tap permit will be issued for the connection to the storm drainage system. 2. DESCRIPTION OF REAL ESTATE AFFECTED. The License Agreement applies to the city right-of--way abutting Lots 1, 2 and 3 all in Block 5 of Kay-Dee Subdivision; located at 1602, 1606 and 1608 Ando Avenue. 3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and independent contractors for any damage or injury that may result to said improvement. If the Licensor, in its sole discretion, determines that any part or all of the improvement must be removed or is damaged by the Licensor, its employees, agents or independent contractors working for the Licensor during the course of 1
