DOUTHIT AND DONNA M. DOUTHIT, hereinafter referred to as the "Licensee". <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to <br />set forth the terms and conditions under which the Licensee may construct, maintain, repair, <br />and utilize the following described improvement which will infringe upon the public right-of <br />way; <br />To place a private discharge pipe in the public right-of--way immediately to the west of <br />Ando Avenue, in front of 1.602, 1606 and 1608 Ando Avenue (Lots 1, 2 and 3 all in Block S <br />of Kay-Dee Subdivision) for the discharge of groundwater directly to a storm drainage area <br />inlet. This private line must meet all code clearances especially when crossing water mains. <br />The water main must be crossed at a 90° angle using either C900 or C905 plastic pipe. The <br />public sanitary sewer and public storm drainage pipes are in the same easement at the Barbara <br />Avenue and Ando Avenue intersection. The Licensee will be responsible for restoring the <br />surface to the same condition it was in prior to the work being done. This license agreement <br />is solely for the permission to place a pipe in the right-of--way and a storm drainage tap permit <br />will be issued for the connection to the storm drainage system. <br />2. DESCRIPTION OF REAL ESTATE AFFECTED. The License Agreement <br />applies to the city right-of--way abutting Lots 1, 2 and 3 all in Block 5 of Kay-Dee <br />Subdivision; located at 1602, 1606 and 1608 Ando Avenue. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the <br />Licensee may construct, maintain, repair and utilize the above described improvement at the <br />Licensee's sole risk. The Licensee hereby waives any claim for damages against the <br />Licensor, its officers, employee, agents and independent contractors for any damage or injury <br />that may result to said improvement. If the Licensor, in its sole discretion, determines that <br />any part or all of the improvement must be removed or is damaged by the Licensor, its <br />employees, agents or independent contractors working for the Licensor during the course of <br />1 <br />
