Olsen, husband and wife (hereinafter <br />referred to as "Borrower") dated May 25, 2007 and recorded June 12, 2007 as <br />Instrument No. 200704845 of the records of Hall County, Nebraska, covering the <br />following described real estate, to-wit: <br /> <br />~ <br />V', <br />o <br /> <br />Lot 14, Grand West Fourth Subdivision, in the City of Grand Island, Hall County, <br />Nebraska. <br /> <br />WHEREAS, Borrower has obtained a loan in the amount of $158,000.00 from <br />Wells Fargo Bank, N.A. (hereinafter referred to as "Lender") which loan is secured by <br />that Deed of Trust dated Api, \ tt<a I ~Oa<1 ,2009 and recorded <br />\v1~ 5, ~oo1 ,2009aslnstrumentNo.Na09a~4-N..;:) ,ofthe <br />recor ed of Hall County, Nebraska, covenng the Subject Real Estate; and <br /> <br />WHEREAS, Lender's Deed of Trust should be paramount and superior to the lien <br />of Bank of the West. <br /> <br />NOW, THEREFORE, Bank of the West does hereby waive the priority of its <br />Deed of Trust as described above and any other security it may have in the subject real <br />estate and agrees that Lender's Deed of Trust shall be superior to said Bank of the West <br />Deed of Trust and the Bank ofthe West agrees that it's Deed of Trust executed and <br />recorded prior to the time of said Lender's Deed of Trust, shall be subject, junior and <br />subordinate to the Deed of Trust of Lender. <br /> <br />Provided, however, that nothing herein contained shall operate in any way to <br />release or affect the validity of the Bank of the West security instruments as liens upon <br />the Subject Real Estate or to otherwise affect the priority of said Bank of the West lien <br />except herein provided. <br /> <br /><2>4 t"-J tQ l q <br />
