<br />NOTICE IS HEREBY GIVEN that on the ~ day of April, 2009, Deutsche Bank
<br />National Trust Company, as Trustee for NovaStar Mortgage Funding Trust, Series 2007-2, as the
<br />plaintiff, filed its Complaint in the District Court of Hall County, Nebraska, against Frank 1.
<br />Hermes and Joan M. Hermes, as the defendants, the object and prayer of such Complaint being to
<br />obtain an accounting, to foreclose a deed of trust executed by said Frank 1. Hermes and Joan M.
<br />Hermes, husband and wife, to Transnation, as Trustee for the benefit of Mortgage Electronic
<br />Registration Systems, Inc., solely as Nominee for NovaStar Mortgage, Inc., Beneficiary, to
<br />foreclose any interest in or lien upon the real estate hereinafter described of the above-named
<br />defendants, to obtain an order for the sale of the real estate hereinafter described for the satisfaction
<br />of the indebtedness secured by such deed of trust and to obtain other equitable relief; that such deed
<br />of trust is dated May 14, 2007, and was recorded on May 18, 2007 as Instrument No. 200704078 in
<br />the Office of the Register of Deeds of Hall County, Nebraska, and conveyed to such beneficiary the
<br />following described real estate situated in Hall County, Nebraska, tOwwit:

<br />NORTHERLY SEVENTY-TWO (72) FEET OF LOT FIVE (5), BLOCK FIFTEEN (IS)
<br />CHARLES WASMER'S ADDITION TO THE CITY OF GRAND ISLAND, HALL
