<br />MODIFICATION OF NOTE
<br />AND
<br />MORTGAGE ASSUMPTION AGREEMENT
<br />WITH RELEASE

<br />WHEREAS, THOMAS J, BEHMER and MARCIA C. BEHMER, husband
<br />and wife, executed and delivered to Commercial National Bank
<br />and Trust Company, a Note and Mortgage on the 13 day of June
<br />1980, in the principal sum of Thirty Six Thousand Dollars
<br />($36,000,00), such Mortgage being filed in the Office of the
<br />Register of Deeds of Hall County, Nebraska, as Document No.
<br />80-002714, on June 13, 1980, conveying the following described
<br />property to Commercial National Bank and Trust Company, and
<br />its assigns:
<br />The West Three Fifths (W 3/5) of Lot Twelve (12),
<br />and the East One Half (E 1/2) of Lot Eleven (11),
<br />all in Block One (l), in Bel Air Addition to the
<br />City of Grand Island, Hall County, Nebraska;
<br />WHEREAS, such Note and Mortgage were assigned to Nebraska
<br />Mortgage Finance Fund as Assignee on the 13 day of June 1980,
<br />and such Assignment of Mortgage was filed with the original
<br />Mortgage in the Orf ice of the Registel" of Deeds of Hall County,
<br />Nebraska, being Document No, 80-002714;
<br />WHEREAS, Thomas J, Behmer and Marcia C. Behmer, husband
<br />and wife, hereinafter referred to as "Borrowers" have sold
<br />the above-described property to DAVID D. MARSH and JACQUELYN
<br />c, ~tARSn, hereinafter referred to as "Purchasers" subject
<br />to modification of the terms of such Note;
<br />WHEREAS, there remains due and owing on said Note the
<br />sum of Thirty Five Thousand Two Hundred Fifty Two and 53/100
<br />Dollars ($35.252,53), and Purchasers wish to pay Nebraska
<br />Mortgage Finance Fund the sum of Six Thousand Two Hundred
<br />Fifty Two and 531100 Dollars (6,252,53), in order to reduce
<br />the amount due and owing on such Note to Twenty Nine Thou&and
<br />Dollars ($29,000,OO), and make monthly installments of Two
<br />Hundred Seventy Nine and 01/100 Dollars ~$279.0l), for principal

<br />and interest commencing on the 1 day of ~ 1984, and on the
<br />first day of each month thereafter until the entire indebtedness
<br />evidenced by the Note is fully paid except that any remaining
<br />indebtedness, if not sooner paid. shall be due and payable
<br />on Julv 1, 2010:
<br />WHEREAS, Purchasers agree to follow the foregoing pro-
<br />visions and all other provisions of the Note and Mortgage
<br />not modified by this Agreement;

<br />property to the undersigned Purchasers and said Purchasers
<br />desire to assume and agree to pay said indebtedness and perform
<br />all obligations under said Loan Contract, and said Nebraska
<br />Mortgage Finance Fund is willing to consent to said transfer
<br />of title and assumption pr said indebt€!dness, and is wdling
