<br />C. F. WHITE and VIRGINIA L. WHITE, Husband and Wife, as
<br />Contract Seller; and RICHARD L. HARTMAN and PATRICIA A. HARTMAN,
<br />Husband and Wife, as Contract. Buyer; herein called the Grantors,
<br />in consideration of One Dollar, receipt of which is hereby
<br />acknowledged, hereby grant, and convey unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called
<br />the Grantee, a permanent and perpetual easement and right -of -way
<br />to survey, construct, reconstruct, relocate, inspect, repair,
<br />replace, extend, add to, maintain, operate, and remove thereon, a
<br />water transmission pipe line, equipment, and other appurtenances
<br />connected therewith, along, across, underneath, and through a
<br />sixteen (16.0) foot wide tract of land located in part of Lot Two
<br />(2) and Lot Three (3) of the Northeast Quarter (NE -1/4) of
<br />Section Ten (10) , Township Ten (10) North, Range Nine (9), West
<br />of the 6th P.M., Hall County, Nebraska; the centerline of the
<br />easement tract being more particularly described as follows:
<br />Beginning at a point on the East line of Lot Two
<br />(2) of Section Ten (10), Township Ten (10) North,
<br />Range Nine (9) West; being fifteen (15.0) feet
<br />South of the Northeast corner of said Lot Two (2);
<br />thence Westerly parallel to the North line of said
<br />Lot Two (2), to a point fifteen (15.0) feet South
<br />of the Northwest corner of said Lot Two (2) ;
<br />thence continuing Westerly to a point on the West
<br />line of Lot Three (3) of said Section Ten (10),
<br />being twenty three (23.0) feet South of the
<br />Northwest corner of said Lot Three (3).
<br />The above tract of land containing 0.984 acres,
<br />more or less, as shown on the plat dated 6/4/86,
<br />marked Exhibit "A ", attached hereto, and
<br />incorporated herein by reference,
<br />together with the following rights:
<br />1. Grantee shall have the right of ingress and egress
<br />across Grantors' property for any purpose necessary in connection
<br />with the survey, construction, reconstruction, relocation,
<br />inspection, repair, replacement, extension, addition to,
<br />maintenance, operation, and removal of said water transmission
<br />pipe line. Such ingress and egress shall be exercised in a
<br />reasonable manner and subject to Grantee's duty to pay Grantors
<br />for any damage as provided in paragraph 3.
<br />2. Grantee shall have the right to trim, clear, or remove
<br />all trees and brush on said right -of -way as may be necessary to
<br />efficiently survey, construct, reconstruct, relocate, inspect,
<br />repair, replace, extend, add to, maintain, operate, and remove
<br />said water transmission pipe line. All refuse from such tree
<br />cutting or trimming shall be removed by Grantee.
<br />3. Throughout the term of this easement, Grantee hereby
<br />agrees to pay the Grantors or Lessee, as their interest may
<br />appear, for any damage to Grantor's property, whether inside or
