86- 105456 <br />LEASE <br />THIS LEASE AGREEMENT is entered into this day of <br />Sept. 1986, between JACK GREENWOOD, hereinafter called the <br />"Lessor" and RICHARD DeVORE and PATRICIA DeVORE, husband and <br />wife, hereinafter called the "Lessee ", as follows: <br />1. Lessor does hereby lease unto the Lessee the following - <br />described property: <br />One (1) Chief Storage Building containing <br />approximately 25,000 bushel capacity located <br />upon the Northeast Quarter (NE.) of Section <br />Fifteen (15), Township Ten (10) North, Range <br />Eleven (11) West of the 6th P.M., in Hall <br />County, Nebraska, <br />together with all improvements thereon and the right to ingress <br />and egress to said facility for a term of one (1) year from <br />October 1, 1986, through September 30, 1987. <br />2. In consideration of the Lease of the above - described <br />building and premises, the Lessee agrees to pay annual rent to <br />the Lessor as follows: <br />a. On October 1, 1986, the corn or other grain to be <br />stored in said facility shall be measured by the parties; the <br />Lessee agrees to pay to Lessor for annual rent through September <br />30, 1987, the sum of .0720 per bushel grain stored in said facility <br />as determined by measurement on October 1, 1986. <br />b. In the event that this Lease should be renewed for <br />an additional one (1) year term as hereinafter provided, the <br />stored grain in said building shall be measured on October 1 <br />of each successive year and the annual rental shall be determined <br />based upon the same rate as set forth in the preceding paragraph. <br />C. The annual rent shall be due and payable in advance <br />on October 1, 1986, and on the 1st day of October of each succes- <br />sive year in the event that this Lease is renewed. <br />3. This Lease may be automatically renewed by the Lessee <br />for an additional one (1) year term provided, the Lessee has <br />given Lessor written notice of Lessee's intent to renew the <br />Lease for one (1) year prior to August 1, 1987, and prior to <br />August 1 of any succeeding year. <br />4. Lessee covenants with the Lessor that at the expira- <br />tion of the term of tnis Lease he will yield up the possession <br />of the leased premises to the Lessor without further demand or <br />notice in as good order and condition as when the same was <br />entered upon by the Lessee, reasonable wear and tear excepted. <br />5. This Agreement shall extend to and be binding upon <br />the Personal Representatives, heirs, successors and assigns of <br />the Lessor and Lessee. <br />J <br />
