<br />PARTNERSHIP WARRANTY DEED
<br />NEBMO PARTNERSHIP, a Nebraska Partnership, GRANTOR, in consid-
<br />eration of Two Hundred Fifty Thousand and No /1.00 Dollars ($250,000.00)
<br />received from C. C. & B. Co., a Nebraska Corporation, conveys to
<br />GRANTEE, the following described real estate (as defined in Neb. Rev.
<br />Stat. 76 -201):
<br />That Part of Section 24, Township 10 North, Range 10
<br />West of the 6th P.M., Hall County, Nebraska, described
<br />as follows: Beginning at a point which is 1,763.25
<br />feet South and 99.63 feet West from the Northeast
<br />corner of said Section 24, (the East line of Sec. 24
<br />assumed North -South in direction) said point being on
<br />the West R.O.W. line of State Highway #281; thence
<br />South 72 °21'58" West, 418.73 feet; thence South
<br />0 26'02" East, 1,229.03 feet to a point on the North -
<br />wegterly R.O.W. line of Interstate #80; thence North
<br />48 52'08" East on saig Interstate R.O.W. line, 298.96
<br />feet; thence North 39 54'17" East on said Interstate
<br />R.O.W. line, 221.44 feet; thence North 5 °16'36" East
<br />on said Interstate R.O.W. line 301.50 feet to a point
<br />on the West R.O.W. line of said State Highway #281;
<br />thency North 0 °26'02" West on the West R.O.W. line of
<br />State Highway #281, 689.12 feet to the point of beginning,
<br />Less that part of the above - described tract which was
<br />dedicated as Lot 1 and Nehmo Subdivision by plat recorded
<br />as Document No. 78- 008323 in the office of the
<br />Register of Deeds of Hall County, Nebraska.
<br />Provided, however, and this conveyance is made upon the following
<br />expressed conditions.and covenants which are hereby declared to run
<br />with the real estate hereby conveyed, and which the Grantee for itself,
<br />its successors and assigns, hereby consents and covenants to observe
<br />and keep, that is to say:
<br />(1) no motel, hotel or lodge, or building with rental sleeping
<br />rooms shall be constructed or maintained on said real estate, except
<br />food and lodging for employees of business' occupying said premises.
<br />(2) no full service restaurant or food facility, or any free-
<br />standing restaurant or food facility, shall be constructed or maintained
<br />on said real estate, except food and lodging for employees of business'
<br />occupying said premises.
<br />The Grantee accepts this conveyance subject to the foregoing
<br />restrictions and conditions and for itself., its successors and assigns,
<br />covenants to and with Grantor, its successors and assigns, that the
<br />Grantee will, and that Grantee's successors and assigns, shall forever
<br />faithfully observe and perform said restrictions and conditions, and
<br />each of them. And i.f the Grantee, or any person claiming under it,
<br />shall at any time violate or attempt to violate, or shall omit to
<br />perform or observe any of the foregoing restrictions and conditions,
<br />then Grantor, its successors or assigns, may institute and prosecute
<br />appropriate proceedings at law or in equity for the wrong done or
<br />attempted, and including the right to enjoin violations of such
<br />restrictions and conditions or to sue in law for appropriate damages.
<br />The foregoing restrictions and conditions are hereby expressly
<br />made an essential part of this instrument, and shall. be and remain
<br />in full force and effect in respect to the said real. estate, and
<br />Grantor and Grantee herein and their respective successors and assi.gns,
<br />until midnight. on December 31, 2009.
