<br />WARRANTY DEED
<br />Douglas M. Mercer, a sinqle person, GRANTOR, in
<br />consideration of LOVE. and AFFECTION, received from Grantor's
<br />Mother, Merna L, Shelburne, GRANTEE, conveys to GRANTEE, the
<br />following described real estate (as defined, in Section 76 -201,
<br />Reissue Revised Statutes of Nebraska, 1943):
<br />Lots One (1), Two (2), Three (3), Four (4), Five (5),
<br />Six (6), Seven (7), Eight (8), Nine (9) and Ten (10),
<br />in Block Two (2), in East park Addition, City of Grand
<br />Island, Hall county, Nebraska, as surveyed, platted and
<br />recorded, including that part of vacated Gilmore Street
<br />abutting on the east side of Lots One (1) and Ten (10)
<br />of Block Two (2) in Fast park Addition in proportion to
<br />the respective ownerships of the lots, as provided in
<br />Ordinance No. 4884 filed of record in the Office of the
<br />Register of Deeds of Hall. bounty, Nebraska, on August
<br />27, 1970, recorded in gook 21 of Miscellaneous Records,
<br />at page 17, but subject to a perpetual easement for
<br />public utilities described in said Ordinance No. 4R84
<br />reserved to the City of Grand island for the public,
<br />subject to the Substituted Purchase Money Real Estate Mortgage
<br />for FIFTEEN THOUSAND DOLLARS (515,000.00) given to Evelyn F.
<br />Wilson, a widow, Mortgagee, filed of record in the office of the
<br />Register of Deeds of Hall County, Nebraska, recorded as Document
<br />No. 85- 004163 on August 28, 1985, which Mortgage GRANTEE assumes
<br />and agrees to pay by acceptance of the delivery of this Warranty
<br />Deed.
<br />GRANTOR covenants with GRANTEE, as follows:
<br />1. GRANTOR is lawfully seised of the above described real
<br />estate;
<br />2. The real estate is free from encumbrances except for the
<br />above described real estate Mortgaqe;
<br />3. The real estate is conveyed to GRANTEE subject to covenants,
<br />restrictions, conditions, reservations, easements of record,
<br />visible easements and zoning laws, rules and regulations;
<br />4. GRANTOR has leqal power and lawful authority to convey the
<br />real estate to GRANTEE; and
<br />5. GRANTOR warrants and will defend title to the real estate
<br />against the lawful claims of all persons.
