86- 1037'7 <br />E L E C T R I C A L E A S E M E N T <br />VIRGIL R. EIHUSEN and HILTON E. CODNER ESTATE, each in their own right, <br />herein called Grantor, in consideration of One Dollar ($1.00) , receipt of <br />which is hereby acknowledged, hereby grants and conveys unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation in Hall County. Nebraska, herein called Grantee, a <br />permanent and perpetual easement and right-of-way to survey, construct, <br />inspect, maintain, repair, replace, extend, remove, and operate thereon, <br />overhead electrical utility lines, poles, anchors, terminals, transformers, <br />surface markers, and other appurtenances connected therewith, in, upon, above, <br />along, across, underneath, and through the Easterly twelve (12.0) feet of Lot <br />Five (5), Reuting`s Second Subdivision, Grand Island, Hall County, Nebraska. <br />The above said easement tract containing 0.055 acres, more or less, as shown <br />on the plat dated 6/19/86, marked Exhibit "A ", attached hereto, and <br />incorporated herein by reference. Together with the following rights: <br />Unrestricted ingress and egress to the above described easement tract for <br />the installation, maintenance, operation, and removal of such overhead <br />electrical utilities and appurtenances. <br />Such rights of ingress and egress shall include all rights necessary for <br />the full and complete use, occupation, and enjoyment of the easement herein <br />granted, including the right to excavate and refill ditches and trenches; to <br />remove, clear, and keep clear trees, bushes, hedges, undergrowth, and other <br />obstructions interfering with the surveying, construction, inspection, <br />maintenance, repair, replacement, extension, removal, or operation of such <br />overhead electrical utilities and appurtenances. No structures, buildings, <br />fences, or other obstructions of any kind whatsoever shall be allowed in, upon, <br />above, along, across, underneath, or through the easement herein granted; <br />except for the existing septic tank, leach field, and appurtenances. <br />Grantor and Grantee hereto agree that the Grantor may continue to use the <br />easement herein granted for any use permitted by law, that does not interfere <br />with the operation and maintenance of the overhead electrical utilities and <br />appurtenances constructed therein. <br />All electrical utility lines. poles, anchors, terminals, transformers, <br />surface markers, and other appurtenances connected therewith, placed in, upon, <br />above, along, across, underneath, and through such easement tract shall remain <br />the property of the Grantee; and may be removed or replaced at anv time. <br />x <br />I <br />
