<br />AGREEMENT made this 24th day of June , 1986,
<br />b%, and between ANDREW BOHNART and MARY G. BOHNART,
<br />husband and wife
<br />o` :rood River, Hall County, Nebraska, herein called "GRANTORS ",
<br />and the CITY OF WOOD RIVER, HALL COUNTY, NEBRASKA, a Municipal
<br />Corporation, herein called "GRANTEE ", S4ITNESSETki:
<br />1. Grantors hereby grant and convey to Grantee a perpetual
<br />easement for the construction, installation, repair, maintenance
<br />and operation of a water main in, into, on, upon, over, across,
<br />and under a strip of land owned by Grantors, legally described
<br />as:
<br />See attached Exhibit "A ".
<br />and more particularly described and set forth in the attached
<br />E:- :hi.bit "A".
<br />2. Consideration. Grantee has paid to Grantors the sum
<br />of Seven Hundred Fifty Dollars
<br />($ 750.00 ) for this easement, receipt of which is hereby
<br />acknowledged by Grantors.
<br />3. Easement to Run with the Land. The Grant of Easement
<br />shall run with the land and shall be binding upon and shall inure
<br />to the benefit of the parties hereto, their heirs, successors
<br />or assigns.
<br />4. Grantors' Restrictions. Grantors, their heirs, successors
<br />or assigns, shall further agree to refrain from the planting of
<br />any bushes, shrubs, or trees, or the placing of anv structures upon
<br />the property herein conveyed, which may interfere with the Grantee's
<br />inspection, operation, repair or replacement of the water main
<br />granted by this easement. Should Grantors, their heirs, successors
<br />or assigns, plant any trees, bushes or shrubs or place any struc-
<br />tures upon the property conveyed which interferes with Grantee's
<br />inspection, operation, repair or replacement of the water main,
<br />costs of removing the same shall be the responsibility of the
<br />Grantors, their heirs, successorsor assigns.
