GRANT OF EASEMENT 86— 103428
<br />AGREEMENT made this 9th day of June , 1986, by
<br />and between MAYNARD DESEL and MARY DESEL, husband and wife,
<br />of Wood River, Hall County, Nebraska, herein called "GRANTORS ",
<br />and the CITY OF WOOD RIVER, Hall County, Nebraska, a Municipal
<br />Corporation, herein called "GRANTEE ", WITNESSETH:
<br />1. Grantors hereby grant and convey to Grantee a perpetual
<br />easement for the construction, installation, repair, maintenance
<br />and operation of a water main in, into, on, upon, over, across,
<br />and under a strip of land owned by Grantors, legally described
<br />as:
<br />The West Twenty (20) feet of Lot Seven (7), Brett's
<br />Addition to the City of Wood River, Hall County,
<br />Nebraska. Said tract containing 0.11 acres, more
<br />or less,
<br />and more particularly described and set forth in the attached
<br />Exhibit "A ".
<br />2. Consideration. Grantee has paid to Grantors the sum
<br />of Three Thousand Nine Hundred Dollars ($3,900.00), which
<br />includes a sum of Three Thousand Eight Hundred Dollars
<br />($3,800.00) for a severance payment for consideration of a
<br />decrease in value to the property by virtue of the easement.
<br />The Grantors acknowledge receipt of total consideration of
<br />Three Thousand Nine Hundred Dollars ($3,900.00).
<br />3. Easement to Run with the Land. The Grant of Easement
<br />shall run with the land and shall be binding upon and shall
<br />'inure to the benefit of the parties hereto, their heirs,
<br />successors or assigns.
<br />4. Grantors' Restrictions. Grantors, their heirs, suc-
<br />cessors or assigns, shall further agree to refrain from the
<br />planting of any bushes, shrubs, or trees, or the placing of any
<br />structures upon the property herein conveyed, which may inter-
<br />fere with the Grantee's inspection, operation, repair or .
<br />replacement of the water main granted by this easement. Should
<br />Grantors, their heirs, successorsor assigns, plant any trees,
<br />bushes or shrubs or place any structures upon the property
<br />conveyed which interferes with Grantee's inspection, operation,
<br />repair or replacement of the water main, costs of removing the
<br />same shall be the responsibility of the Grantors, their heirs,
<br />successors or assigns.
