FIM1ER AND GBORCIE ANN FISCMER, HUSBAND AND WIFE, whether one or more, herein called the Trustor, and Arend Baack, Attorney at Law, hereinafter [: referred to as Trustee, and THE 0VERIrAM NATIONAL BANK OF GRAND ISLAND, Grand Island, Nebraska, hereinafter referred to as Beneficiary, hereby agree as follows: 1. Trustor has executed and delivered to Trustee a Deed of Trust dated July 31, 1985, and recorded on August 1, 1985, as Docunent No. 85- 003676 in the office of the Register of Deeds, Hall County, Nebraska, in consideration of a certain Deed of Trust Note for $46,524.15, a valid subsisting obligation of the Trustor, and payment of the reminder of the principal and accrued interest thereon shall be due according to the terms of the aforementioned Deed of Trust, modified and payable in the following manner: A Deed of Trust Note dated July 31, 1.985, on which a principal balance of $46,524.15 now remains unpaid, will be payabI.e on demand, or in the event. demand shall not sooner be made, said note will be payable in full on April 5, 1987. 2. All other terms and conditions contained in the original Deed of Trust dated July 31, 1985, shall remain the same, and this Modification Agreement is made a part of the original Deed of Trust by reference and shall inure to all successors and assigns and their heirs.
