<br />SPECIAL WARRANTY DEED
<br />KNOW ALL MEN BY THESE PRESENTS: THAT we, JAMES L. FOX, JR. AND JUDY
<br />A. FOX, husband and wife, of the county of Hall, State of Nebraska,
<br />have agreed to give up and surrender the lands hereinafter described
<br />in lieu of a foreclosure, as security for the amount of money remaining
<br />unpaid on said Deed of Trust, do hereby sell and convey upon FIRST
<br />FEDERAL SAVINGS AND LOAN ASSOCIATION OF LINCOLN, a United States
<br />Corporation, its successors and assi4ns, for and in consideration of
<br />the sum of One and No /100 Dollar ($1.00), and other valuable consideration,
<br />the following described premises, to -wit:
<br />Lot One (1), Block Two (2), LeHeights Subdivision,
<br />a part of the Northwest Quarter of the Northwest
<br />Quarter (NW1 /4NW1 /4) of Section 11, Township 11
<br />North, Range 10 West of the 6th P.M., Hall Countv,
<br />Nebraska.
<br />together with all appurtenances thereunto belonging, free and clear of
<br />all encumbrances except a Deed of Trust in favor of Joseph H. Badami,
<br />Trustee, and First Federal Savings and Loan Association of Lincoln,
<br />Lincoln, Nebraska, as Beneficiary, the principal sum of Twenty -eight
<br />Thousand Four Hundred and No /100 Dollars ($28,400.00), dated June 8,
<br />1983 and filed for record June 8, 1983, in Document No. 83- 002896, of
<br />the records of Hall County, Nebraska, and easements and restrictions
<br />of record, and do covenant to warrant and defend the said premises
<br />against any act of said _grantors or any other person claiming through
<br />or under it. The grantee hereby releases and discharges any and all
<br />liens and claims under and by virtue of the Deed of Trust aforesaid
<br />for a deficiency judgment. The grantors further covenant that this
<br />conveyance is and does constitute an absolute conveyance of title to
<br />the premises to the grantee herein in effect as well as form, and is
<br />not intended as a mortgage, trust conveyance, or as security of any
<br />kind and that possession of the premises is delivered concurrently
<br />herewith. And the said urantors hereby relinquish all right, title,
<br />interest and all equity of redemption in and to the above described
<br />premises.
