86-- 100540 WARRANTY DEED L & D PROPERTIES, a partnership, herein called the Grantor, for and in consideration of the cancellation of indebtedness mowing from Grantor to Grantees, does grant„ bargain, sell, convey and confirm unto LARRY L. LEEP and DONALD R. SALADEN, as tenants in common, herein called the Grantees, the following - described real estate in Hall County, Nebraska: Lot One (1), Block Ten (1.0), University Place, an Addition to the City of Grand Island, Hall County, Nebraska, and Lot Seventeen (17), Block Fourteen (14), Ashton Place,, an Addition to the City of Grand Island, Hall County, Nebraska. TO HAVE AND TO HOLD the premises above described, together with all the tenements, hereditaments and appurtenances thereunto belonging, unto the said Grantees and to Grantees' heirs and assigns forever. And Grantor hereby covenants with the said Grantees and with Grantees' heirs and assigns, -that Grantor is lawfully seized of said premises, that they are free from all liens and encumbrances except liens and encumbrances of record and that Grantor has good right and lawful authority to sell the same; and Grantor hereby covenants to warrant and defend the title to said premises against the lawful claims of all persons claiming the same or any part thereof through, by or under Grantor. Grantor acknowledges that the transfer of the real estate to Grantees is made for the benefit of Grantees and it is the intention of the parties to the Agreement that such transfer will not result in a merger of Grantees' interest and the existing security interest of Grantees in the title conveyed to Grantees by Grantor. This Warranty Deed is given as an absolute conveyance, the Grantor having conveyed said land to the Grantees for a fair and adequate consideration, such consideration being satisfaction of principal obligations secured by the Mortgage executed by Grantor to Grantees as mortgagees recorded as Document No. 82- 004721 in the Office of the Register of Deeds, Hall County, Nebraska. Grantor declares that this conveyance is freely and fairly made, and that there are no agreements, oral or written, or other than this deed, between Grantor and Grantees with respect to said land.
