McElroy and Becky L. McElroy, husband <br />and wife (the "McEiroys"), as trustor, Oil J"110 1, 1983 made, <br />executed and delivered to Stewart Title Guaranty Company <br />("Stewart"), as trustee, and Superior Mortgage, Inc. <br />("Superior"), as beneficiary, a deed of trust (the "Deed of <br />Trust") covering the following described property (the <br />"Property"): <br />Lot Twelve (12) in Block Ten (10) in Ashton Place, <br />an Addition to the City Of Grand island, Hall <br />County, Nebraska; <br />WHEREAS, the Deed of Trust was given as security for the <br />repayment of the indebtedness evidenced by the McElroy's note <br />to Superior dated June 1, 1983, which Deed of Trust was <br />recorded June 1, 1983 in the office of the Register of Deeds <br />of Hall County, Nebraska as Document Number 83-002742; and <br />WHEREAS, on or about February 19, 1985, James B. <br />McElroy, then an unmarried widower, executed and delivered a <br />Survivorship Warranty Deed conveying the Property to <br />Curtis K. Oerter and Nancy L. Oerter, husband and wife <br />(collectively, the "Trustor"), in consideration for which <br />conveyance Trustor assumed and agreed to assume the <br />obligations of said James B. McElroy under the Deed of Trust; <br />and <br />WHEREAS, the interest of Superior as beneficiary under <br />the Deed of Trust has been assigned to Goldome Realty Credit <br />Corp., 205 Park Club Lane, post office Box 9000, Buffalo, New <br />York 14221-9000 ("Beneficiary"); and <br />WHEREAS, Stewart has been replaced as trustee by <br />Daniel T.
