88- 105046 ASSIGNMENT OF RAILROAD LEASE RNOW ALL KEN BY THESE PRESEllTS: For and in consideration of the sum of One Dollar ($1.00) and for other good and valuable consideration, the receipt whereof is hereby acknowledged, the BANK OF DONIPHAN, a Nebraska corporation, does hereby assign to CHIEF INDUSTRIES, INC., a Delaware corporation, with its principal office at Grand Island, Nebraska, all of the assignor's right, title, claim and interest in and to the following described Railroad Right-of-way Lease: 1. Lessor: Union Pacific Railroad Company. 2. Lessee: The Big "H" Equipment Company, a Nebraska corporation 3. 1968. Lease Term: Twenty (20) years beginning February 1, 4. Real Estate Leased: All of that part of the West Half (W~) of section Twenty-six (26), Township Eleven (11) North, Range Ten (10) West of the 6th principal Meridian, which is included between lines parallel with and a distance respectfully fifty (50) feet and two hundred (200) feet when measured at right angles on the southerly side from the center line of the most southerly or east bound main tract of the railroad of the Lessor, as said tract is constructed, maintained, and operated over and across said Section Twenty-six (26) in Hall county, Nebraska. 5. Recorded in the office of the Register of Deed of Hall County, Nebraska, at Book 17, at Page 431- Assignee warrants that it has received a copy of the Lease and agrees to be bound by the terms hereof as the original Lessee. Assignor warrants that it has transferred its title in the real estate which affects the above described real estate to assignee and that it has given the Union Pacific Railroad Company notice of this assignment.
