<br />E L E C T R I C A L <br /> <br />E A S E HEN T 88- <br /> <br />104772 <br /> <br />BERNSTELIi REAL ESTATE COMPANY, a Partnership, herein called the Grantor, <br /> <br />in consideration of <br /> <br />One Dollar ($1.00) <br /> <br />, receipt of which is hereby <br /> <br />acknowledged. hereby grants and conveys unto the <br /> <br />CITY OF GRAND ISLAND, NEBRASKA, <br /> <br />a municipal corporation in Hall County, Nebraska, herein called the Grantee, a <br /> <br />permanent and perpetual easement and right-af-way to survey, construct, <br /> <br />inspect, maintain. repair, replace, extend, remove, and operate thereon, <br /> <br />underground electrical utility lines, cables, terminals, transformers, surface <br /> <br />markers, and other appurtenances connected therewith, in, upon. above, along, <br /> <br />across, underneath, and through a tract of land located in part of Lot Seven <br /> <br />(7) and in part of Lot Eight (8), Chief Industries Subdivision, Grand Island. <br /> <br />Nebraska~ the easement being more particularly described as follows: <br /> <br />The Southerly twelve and five-tenths (12.5) feet of the <br />Westerly fifteen (15.0) feet of said Lot Seven (7), Chief <br />Industries Subdivision. and <br /> <br />The Northerly three and five-tenths (3.5) feet of the <br />Westerly fifteen (15.0) feet of said Lot Eight (8), Chief <br />Industries Subdivision. <br /> <br />The above described tract of land containing 240.0 square <br />feet, more or less, as shown on the plat dated 8/22/88. <br />marked Exhibit "A", attached hereto, and incorporated <br />herein by reference, <br /> <br />together with the following rights: <br /> <br />Unrestricted ingress and egress to the above described easement for the <br /> <br />installation, maintenance, operation, and removal of such underground <br /> <br />electrical utility lines and appurtenances. <br /> <br />Such rights of ingress and egress shall include all rights necessary for <br /> <br />the full and complete use, occupation. and enjoyment of the easement herein <br /> <br />granted including, but not limited to, the right to remove, clear, and keep <br /> <br />clear trees, bushes, hedges, undergrowth, and other obstructions interfering <br /> <br />with the surveying, construction, inspection. maintenance. repair, replacement, <br /> <br />extension, removal, or operation of such underground electrical utility lines <br /> <br />and appurtenances. No structures, buildings, fences, or other obstructions of <br /> <br />any kind whatsoever, shall be allowed in, upon, above, along, across. <br /> <br />underneath, or through the easement herein granted. <br /> <br />The Grantor and the Grantee hereto agree that the Grantor may use the <br /> <br />easement area granted for any use permitted by la~, that does not interfere <br /> <br />with the operation and maintenance of the underground electrical ut i 1 i ty 1 ines <br /> <br />and appurtenances const.ruct.ed t.herein. <br /> <br />- I - <br />
