88-101379 GRANT In consideration of the payment of TEN AND XX/lOa DOLLARS ($10.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, DOUGLAS R. PETERSEN and TAMERA K. PETERSEN, husband and wife, and MARGARET MAE PETERSEN and DONALD PETERSEN, husband and wife, (collectively "Grantors") do hereby grant and convey unto AT&T Communications of the Midwest, Inc., and its associated and allied companies (defined to include American Telephone and Telegraph Company, its parent and its subsidiaries) a right of way and easement to construct, operate, maintain, replace and remove an underground fiber optic cable system consisting of a single cable and associated appurtenances (inClUding conduit, casings, warning tapes), manholes, splicing boxes, and markers) upon, across and under a strip of land 16.5 feet wide, described as set forth on Exhibit 1, across the Grantor's land being the East ~ of the East % of the Southwest % lying North and East of the Railroad Right of Way, and that part of the West % of the West ~ of the Southeast ~ lying North and East of the Railroad Right of Way, all in Section Four (4), Township Eleven (11) North, Range Nine (9) West of the 6th P.M. in Hall County, Nebraska, together with the fOllowing rights: rights of ingress and egress to, from, and along lands adjacent to said strip for the purpose of constructing and maintaining said communicatiJns system (inCluding specifically for construction purposes a temporary easement 50 feet wide, being 25 feet on either side of the path of the cable); the right to place above-ground markers at fence lines, property lines and ditch banks; the right to clear and keep cleared all trees, roots, brush and other obstructions from the surface and subsurface of said strip and during construction to cut all trees within 10 feet thereof; and the right to install gates in any fences crossing said strip. The Grantors, for themselves, their heirs, successors and assigns hereby covenant that no structure shall be erected or permitted on said strip, but reserve the right to cross said strip with roads, driveways, field tile and other utilities inClUding water, electricity, gas and sewer lines and to continue ordinary cultivation of said strip.
