<br />88-101379 <br /> <br />GRANT <br /> <br />In consideration of the payment of TEN AND XX/lOa DOLLARS <br />($10.00) and other good and valuable consideration, the receipt <br />of which is hereby acknowledged, DOUGLAS R. PETERSEN and TAMERA <br />K. PETERSEN, husband and wife, and MARGARET MAE PETERSEN and <br />DONALD PETERSEN, husband and wife, (collectively "Grantors") do <br />hereby grant and convey unto AT&T Communications of the <br />Midwest, Inc., and its associated and allied companies (defined <br />to include American Telephone and Telegraph Company, its parent <br />and its subsidiaries) a right of way and easement to construct, <br />operate, maintain, replace and remove an underground fiber <br />optic cable system consisting of a single cable and associated <br />appurtenances (inClUding conduit, casings, warning tapes), <br />manholes, splicing boxes, and markers) upon, across and under a <br />strip of land 16.5 feet wide, described as set forth on Exhibit <br />1, across the Grantor's land being the East ~ of the East % of <br />the Southwest % lying North and East of the Railroad Right of <br />Way, and that part of the West % of the West ~ of the Southeast <br />~ lying North and East of the Railroad Right of Way, all in <br />Section Four (4), Township Eleven (11) North, Range Nine (9) <br />West of the 6th P.M. in Hall County, Nebraska, together with <br />the fOllowing rights: rights of ingress and egress to, from, <br />and along lands adjacent to said strip for the purpose of <br />constructing and maintaining said communicatiJns system <br />(inCluding specifically for construction purposes a temporary <br />easement 50 feet wide, being 25 feet on either side of the path <br />of the cable); the right to place above-ground markers at fence <br />lines, property lines and ditch banks; the right to clear and <br />keep cleared all trees, roots, brush and other obstructions <br />from the surface and subsurface of said strip and during <br />construction to cut all trees within 10 feet thereof; and the <br />right to install gates in any fences crossing said strip. <br /> <br />The Grantors, for themselves, their heirs, successors and <br />assigns hereby covenant that no structure shall be erected or <br />permitted on said strip, but reserve the right to cross said <br />strip with roads, driveways, field tile and other utilities <br />inClUding water, electricity, gas and sewer lines and to <br />continue ordinary cultivation of said strip. <br /> <br />The rights herein granted shall revert to the Grantors if the <br />Grantees abandon the easement area for a period of ten (10) <br /> <br />L <br /> <br />--1 <br /> <br />L <br />
