''', I--" Z <br />tat. 76-1006 and the Deed of Trust now in default, which Deed of Trust is referred to in this Notice: 0 <br /> <br />1. The Deed of Trust is: Dated December 31, 1998. Trustor is Randy Dethlefs, a/k/a <br />Randy L. Dethlefs. Trustee is Galen E. Stehlik. Beneficiary is Doax Investment Co., a Nebraska <br />partnership. This Deed of Trust is recorded in the Register of Deeds Office of Hall County as <br />Document No. 99-100232. <br /> <br />2. The particulars necessary to exercise the power of sale written into the Deed ofT rust <br />referred to above is: <br /> <br />a) A breach of the obligation for which the trust property was conveyed as <br />security has occurred. <br /> <br />b) The beneficiary has elected to declare the entire amount of the Promissory <br />Note, which is secured by the Deed of Trust herein due and payable at once. The nature of the <br />breach of the obligation secured by the Deed of Trust is the failure of the Trustors "to pay an <br />installment of principal or interest or any other sum secured hereby when due". Specifically, to pay <br />installment payments of principal and interest and taxes and insurance. Given these defaults the <br />Trustee, as instructed by the Beneficiary, has elected to "sell the Trustor's interest in the property and <br />the proceeds thereofto be distributed, all in the manner provided for in the Nebraska Trust Deeds <br />Act" . <br /> <br />c) <br />by the Trustor. <br /> <br />The trust property is not known to be used in farming operations carried on <br /> <br />d) The Trustor's default may be cured within one (1) month of the filing for <br />record of this Notice of Default and, if the Trustor does that, then the obligation in the trust deed may <br />be reinstated as provided in the Deed of Trust and in Neb, Rev. Stat. 76-1012. <br /> <br />e) Expenses ofthe Trustee to the date of any reinstatement, to include attorney's <br />fees ~ provided in the Deed of Trust and/or Neb. Rev. Stat. 76-1012 - apply and are assessed, <br />together with costs of any title evidence. These amounts, together with the total of the obligation <br />owed by the Trustor as expressed in this Notice of Default, shall be given by the Trustee upon <br />request. <br /> <br />1 <br />
