<br />County, State of Nebraska, herein referred to as trustor, and EQUITABLE FEDERAL SAVINGS
<br />BANK OF GRAND ISLAND, of 113 N. Locust St., City of Grand Island, County of Hall, State
<br />of Nebraska, herein referred to as beneficiary.
<br />The parties recite and declare that:
<br />a. Trustor executed a trust deed on March 6, 2002, in favor of beneficiary, which was
<br />recorded on March 14, 2002, in the office of the Register of Deeds, as Document No.
<br />200202804, in Hall County, State of Nebraska, covering the following described properly (as
<br />defined in Neb. Rev. State. 76 -201) in Hall County, Nebraska.
<br />PARCEL 1: LOT FIVE (5), EXCEPTING A CERTAIN TRACT DESCRIBED IN WARRANTY DEED RECORDED
<br />IN BOOK 137, PAGE 559 AND THE WESTERLY NINETEEN (19) FEET OF LOT SIX (6), ALL IN BLOCK ONE
<br />(1), WINDOLPH'S ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA.
<br />PARCEL 2: PART OF LOT 5, BLOCK 1, WINDOLPH'S ADDITION, CITY OF GRAND ISLAND, HALL
<br />COUNTY, NEBRASKA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT A POINT 27.2
<br />FEET SOUTH AND 8.5 FEET WEST OF THE NORTHEAST CORNER OF SAID LOT 5; THENCE RUNNING
<br />NORTHERLY PARALLEL WITH THE EASTERLY LOT LINE OF SAID LOT 5, A DISTANCE OF 27.2 FEET;
<br />THENCE TURNING AND RUNNING WESTERLY ALONG AND UPON THE NORTHERLY LOT LINE OF SAID
<br />LOT 5, A DISTANCE OF 57.5 FEET TO THE NORTHWEST CORNER OF SAID LOT 5; THENCE TURNING AND
<br />RUNNING SOUTHERLY ALONG AND UPON THE WESTERLY LOT LINE OF SAID LOT 5, A DISTANCE OF
<br />40.0 FEET, THENCE TURNING AND RUNNING EASTERLY PARALLEL WITH THE NORTHERLY LOT LINE OF
<br />SAID LOT 5, A DISTANCE OF 48.6 FEET TO A POINT; THENCE TURNING AT AN ANGLE AND RUNNING
<br />NORTHEASTERLY, A DISTANCE OF 16 FEET 3'h INCHES TO THE POINT OF BEGINNING.
<br />b. The above mentioned trust deed was given as security for Loan, described in such
<br />trust deed, in the original amount of FORTY -SEVEN THOUSAND SEVEN HUNDRED
<br />NTNF,TY -SIX AND 42/100 - -- ($47,796.42) Dollars, executed on March 6, 2002, by trustor in
<br />favor of beneficiary.
<br />c. Tmstor desires to obtain a loan in the amount of One IIundred Fourteen Thousand
<br />Four Hundred and No /100 ($114,400.00) Dollars -- from Equitable Federal Savings Bank of
<br />Grand Island, of 113 N. Locust, City of Grand Island, County of Hall, State of Nebraska, herein
<br />referred to as lender, but lender requires that such loan be secured by a trust deed that will be
<br />prior to the trust deed in favor of beneficiary.
