<br />John H. Matthes and Linda K. Matthes, husband and wife, dated June
<br />10, 1996, and recorded June 20, 1996, in the Office of the
<br />Register of Deeds of Hall County, Nebraska as Document No. 96-
<br />104825, and Deed of Trust dated March 28, 1989, and recorded March
<br />29, 1989, in the Office of the Register of Deeds of Hall County,
<br />Nebraska as Document No. 89- 101563, said Deed of Trust securing
<br />the following property:
<br />Lot One (1), Block Fourteen (14), College Addition to
<br />West Lawn, City of Grand Island, Hall County, Nebraska,
<br />said Deeds of Trust being in favor of Five Points Bank, a Nebraska
<br />corporation, Beneficiary under said Deed of Trust.
<br />Said default under the terms of the Deeds of Trust has
<br />occurred by virtue of nonpayment of the payments as they became
<br />due and payable under the following notes:
<br />(1) Promissory Note No. 775343 dated October 7, 2002, in the
<br />principal sum of Eighty Nine Thousand and Ninety Dollars and 55
<br />Cents ($89,090.55) together with interest at the rate of 8% per
<br />annum payable on demand, with a total principal balance due and
<br />owing as of March 14, 2005, in the sum of Eighty One Thousand Nine
<br />Hundred and Eighty - -Eight Dollars and 62 Cents ($81,988.62) and
<br />unpaid interest of Two Thousand Eight Hundred Ninety -Six Dollars
<br />and 93 Cents ($2,896.93), current escrow balance of Four Hundred
<br />Eighty -Five Dollars and 63 Cents ($485.63) and current late charge
<br />of Two Hundred Dollars ($200.00) for a total payoff as of March
<br />14, 2005, of Eighty Five Thousand and Eighty -Five Thousand Dollars
