CD r N CIO W c,y f CJ'1 tW O Cn CD i� • This Space Reserved for Register of Deeds • LICENSE AGREEMENT This License Agreement is made by and between the CITY OF GRAND ISLAND, NEBRASKA, a Municipal Corporation, herein referred to as the "Licensor" and Tim Tedak and Kendall J. Terjak, formerly known as Kendall J. Packer, husband and wife, hereinafter referred to as the "Licensees." 1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions under which the Licensees may construct, maintain, repair, and utilize the following described improvement which will infringe upon the right -of -way held by the Licensor: Utilization of the north three (3.0) feet of the alley between North Eddy Street and Clark Street, and between 2nd Street and 3rd Street in Grand Island, Nebraska. Such utilization shall be for three (3.0) parallel parking stalls on the south side of the building located at 216 N. Eddy as shown on the attached drawing. 2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensees own the following described real estate adjacent to the Licensor's right -of -way to which this License Agreement shall apply: The South Thirty Nine (39.0) feet of Lot One (1), Block One Hundred Fourteen (114), Railroad Addition to the City of Grand Island, Hall County, Nebraska. 3. LICENSEES' DUTIES AND RISKS. It is understood and agreed that the Licensees may construct, maintain, repair and utilize the above described improvement at the Licensees' sole risk. The Licensees hereby waive any claim for damages against the Licensor, its officers, employees, agents and independent contractors for any damage or injury that may result to said improvement.
