Terjak, formerly known as Kendall J. Packer, husband and wife, hereinafter referred <br />to as the "Licensees." <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set <br />forth the terms and conditions under which the Licensees may construct, maintain, repair, and <br />utilize the following described improvement which will infringe upon the right -of -way held by <br />the Licensor: <br />Utilization of the north three (3.0) feet of the alley between North Eddy Street and <br />Clark Street, and between 2nd Street and 3rd Street in Grand Island, Nebraska. <br />Such utilization shall be for three (3.0) parallel parking stalls on the south side of <br />the building located at 216 N. Eddy as shown on the attached drawing. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensees own the <br />following described real estate adjacent to the Licensor's right -of -way to which this License <br />Agreement shall apply: <br />The South Thirty Nine (39.0) feet of Lot One (1), Block One Hundred Fourteen <br />(114), Railroad Addition to the City of Grand Island, Hall County, Nebraska. <br />3. LICENSEES' DUTIES AND RISKS. It is understood and agreed that the <br />Licensees may construct, maintain, repair and utilize the above described improvement at the <br />Licensees' sole risk. The Licensees hereby waive any claim for damages against the Licensor, its <br />officers, employees, agents and independent contractors for any damage or injury that may result <br />to said improvement.
