2009_i0352 AGREEMENT SUBORDINATING EXISTING
<br />DEED OF TRUST TO NEW TRUST DEED
<br />Agreement made the 23 day of SEPTFMRFR 2002, between Randy T. Smaha
<br />and Sharon A. Smaha, Husband and Wife, 2416 Pioneer Blvd., Grand Island, Hall County,
<br />Nebraska, herein referred to as Trustor, and Five Points Bank, herein referred to as Beneficiary.
<br />The parties recite and declare that:
<br />a. Randy T. Smaha and Sharon A. Smaha executed a Deed of Trust on October 31, 2000
<br />in favor of Beneficiary, which was recorded on November 7, 2000, in the office of the Register
<br />of Deeds of Hall County, State of Nebraska, as Document No. 0200009660, covering the
<br />following described property:
<br />LOT (l) BLOCK "D °PARKVIEW SUBDIVISION LOCATED IN THE NORTHEAST QUARTER
<br />(NE %) OFSEC77ON TWENTYNINE (29) AND THENORTNWESTQUARMN (NW %) OF
<br />SECTION TWENTYEIGHT(28) TOWNSHIP ELEVEN (77) NORTH RANGENINE (9) WEST OF
<br />T.NE Er'r P.M., HALL COUNTY NEBRASKA.
<br />b. The above mentioned Deed of Trust was given as security for a Loan, described in
<br />such Deed of Trust, in the amount of Five Thousand Seventy -Six and 24/100 - --
<br />($5,076.24) Dollars, executed on October 31, 2000, by Truster in favor of
<br />Beneficiary.
<br />c. Trustor desires to obtain a loan in the amount of Seventy Five Thousand and No /I00-
<br />($75,000.00) -- from Equitable Federal Savings Bank of Grand Island, P.O. Box 160, City of
<br />Grand Island, County of Hall, State of Nebraska, herein referred to as lender, but lender requires
<br />that such loan be secured by a trust deed that will be prior to the Deed of Trust in favor of
<br />Beneficiary.
<br />d. Beneficiary is willing to subordinate the lien of the Deed of Trust in their favor
<br />insofar as it encumbers the above - described premises, to the trust deed made in favor
<br />of lender in order that Trustor may have a proper priority of such loan from lender.
<br />Said Deed of Trust securing lender's lien was recorded as Document No.
<br />00C - 5 . in the Office of the Hall County Register of Deeds.
<br />For the reasons set forth above, and in consideration of the mutual covenants and
<br />promises of the parties hereto, Trustor and beneficiary covenant and agree as follows:
