Locust, Ste. 501 <br />Grand Island, NE 68801 <br />) L9 ° ° <br />RECORDING INSTRUCTIONS: <br />RECORD AGAINST: the following described property located in Hall County, Nebraska, to <br />wit: Outlot K, Legacy 34 Third Subdivision , Outlot A and Lot Two (2), Legacy 34 Fourth <br />Subdivision <br />SHARED MAINTENANCE AGREEMENT <br />THIS SHARED MAINTENANCE AGREEMENT is made and entered into this <br />3/- day of ,2eceft be,/ , 20a1/ , by and between Prairie District <br />Commercial Association, Inc., a Nebraska nonprofit corporation (the <br />"Association"), and Teta Hospitality, Inc., a Nebraska corporation ("Teta"). <br />RECITALS: <br />WHEREAS, the Association is the owner of Outlot A, Legacy 34 Fourth <br />Subdivision in the City of Grand Island, Hall County, Nebraska, which is a private drive <br />known as "Innate Lane", and Outlot K, Legacy 34 Third Subdivision in the City of Grand <br />Island, Hall County, Nebraska ("Outlot K"), which is a detention cell; and <br />WHEREAS, Teta is the owner of Lot Two (2), Legacy 34 Fourth Subdivision in <br />the City of Grand Island, Hall County, Nebraska ("Lot 2); and <br />WHEREAS, the parties desire to enter into this Agreement providing for <br />maintenance, repair, snow removal and landscaping of Innate Lane and Outlot K at a <br />shared cost. <br />NOW, THEREFORE, IT IS AGREED by and between the parties as follows: <br />1. The Association, its successors and assigns agree to provide maintenance, <br />repair, snow removal, landscaping and related care for Innate Lane and <br />Outlot K (the "Services") on the following terms: <br />a. The Association, by and through its employees, contractors or <br />subcontractors, shall perform the Services on a timely basis, <br />expediting snow removal on Innate Lane. <br />b. The Association shall provide to Teta an itemized statement of the <br />Services provided and commercially reasonable costs incurred for <br />the performance of the Services on a monthly basis. <br />c. Within 30 days of receipt of the invoice, Teta shall pay 21% of the <br />Services related to Innate Lane and 50% of the Services related to <br />Outlot K. <br />1 <br />
