T = y <br />n n Z lm) _ \, o o o <br />m N Q �`. c-D C N CD <br />7nC = N rM*1 �-i M O CO <br />h O C2. <br />CA) O Tj C) Imp <br />P d <br />Ch rh r s/s <br />cz� r n �-' C <br />C-0 tQ i i c o <br />N � � i CJl <br />` Ca W <br />f1> <br />DEED OF TRUST MODIFICATION AGREEMENT <br />(Variable Rate to Fixed) <br />THIS DEED OF TRUST MODIFICATION AGREEMENT made and executed this <br />9TH day of OCTOBER, 2001, by and between CHARLES R WINKLER AND DORIS L _ <br />WINKLER, HUSBAND AND WIFE, hereinafter referred to as "Borrower ", and HOME ca <br />FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, hereinafter referred cJ� <br />to as "lender ", ° <br />WITNESSETH: <br />WHEREAS, Borrower did execute a certain Adjustable Rate Note payable to the order of <br />the Lender in the total original amount of ONE HUNDRED TWENTY THOUSAND AND <br />NO1100 , Dollars ($120.000.00); <br />WHEREAS, the Note described above was secured by a Deed of Trust with Adjustable <br />Rate Rider dated OCTOBER 19, 1992, filed of record in the Office of the Hall County <br />Register of Deeds on OCTOBER 23, 1992 as Document No. 92- 109147 in respect to that real <br />estate described as: <br />LOT TWENTY TWO (22) AND TWENTY THREE (23) SITUATED ON THE WEST SIDE OF <br />THE EAST PORTION OF KUESTER' S LAKE AND BOUNDED ON THE WEST SIDE BY <br />THE COMMON ROAD AND BEING ON A PART OF THE EAST HALF OF THE <br />SOUTHWEST QUARTER (E 1/2 SW 1/4) OF SECTION THIRTEEN (13), TOWNSHIP <br />ELEVEN (11) NORTH, RANGE NINE (9) WEST OF THE 6TH P.M., HALL COUNTY, <br />NEBRASKA <br />WHEREAS, Borrower has requested that interest be converted to a fixed rate rather than <br />the variable rate specified by such Deed of Trust with Adjustable Rate Rider and that the stated <br />maturity date be also hereby modified; <br />WHEREAS, Lender is willing to convert such variable rate loan into a fixed rate loan to <br />be secured by such Deed of Trust with Adjustable Rate Rider and modify the existing maturity <br />date; <br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust <br />with Adjustable Rate Rider identified hereinabove to provide that it shall continue to secure the <br />presently remaining indebtedness from and after the date hereinafter specified together with a <br />fixed rate of interest rather than a variable rate as originally set forth in such Adjustable Rate <br />Rider; <br />NOW, THEREFORE, it is agreed: <br />1. Interest Rate and Maturity Modification. Commencing effective NOVEMBER 1 <br />2001, the indebtedness secured by the Deed of Trust with Adjustable Rate Rider hereinabove <br />identified shall accrue interest at a fixed rate of SIX AND ONE QUARTER percent 6.25% <br />throughout the remaining term of such indebtedness and, notwithstanding the provisions <br />contained in the Adjustable Rate Rider, there shall be no further adjustments to such interest <br />rate. The final maturity of such indebtedness as modified, secured by such Deed of Trust shall <br />be OCTOBER 1, 2016, notwithstanding any other date of maturity which may have been <br />specified in the Deed of Trust hereinabove identified. <br />
