<br />This License Agreement is made by and between the CITY OF GRAND ISLAND, NEBRASKA, a municipal
<br />Corporation, herein referred to as the "Licensor" and JNIK, LLC & Jim Nikodym Trust , Owner, hereinafter
<br />referred to as the "Licensee".
<br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions,
<br />under which the Licensee may construct, maintain, repair, and utilize the following described improvement which
<br />will infringe upon a public utility easement:
<br />Installation, maintenance and repair of six (6) foot tall plastic privacy fence and concrete drainage flume within
<br />the drainage easement at the north end of the property addressed as 984 Vandervoort Avenue, 992
<br />Vandervoort Avenue, 1002 Vandervoort Avenue, 1008 Vandervoort Avenue, 1014 Vandervoort Avenue, 1020
<br />Vandervoort Avenue, 1026 Vandervoort Avenue, 1032 Vandervoort Avenue, 1038 Vandervoort Avenue, 1044
<br />Vandervoort Avenue, 1056 Vandervoort Avenue and the east end of the property addressed as 1062
<br />Vandervoort Avenue, 589 Root Street, 595 Root Street, 605 Root Street, 613 Root Street, 621 Root Street,
<br />629 Root Street, 637 Root Street, 645 Root Street, 653 Root Street, and 661 Root Street, all per attached
<br />Exhibit "A", dated 2023/6/16.
<br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns the following described real estate
<br />adjacent to the Licensor's public utility easement to which this License Agreement shall apply:
<br />LOTS NINE (9), TEN (10), ELEVEN (11), TWELVE (12), THIRTEEN (13), FOURTEEN (14), FIFTEEN (15),

<br />TWENTY-THREE (23), TWENTY-FOUR (24), TWENTY-FIVE (25), TWENTY-SIX (26), TWENTY-SEVEN (27),
<br />TWENTY-EIGHT (28), TWENTY-NINE (29), THIRTY (30), AND THIRTY-ONE (31), NIKODYM THIRD
<br />SUBDIVISION, CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA.
