Schnabel, being first duly sworn, deposes and says: <br />('1 <br />1. That Affiant is the surviving spouse of Bonnilee R. Schnabel, (hereinafter referred to as <br />the "Decedent") and is now the sole successor trustee and the sole beneficiary of the Bonnilee R. <br />Schnabel Revocable Trust Agreement dated May 14, 1999, and First Amendment thereof dated <br />December 21, 2001 and Restated on December 23, 2002 (hereinafter referred to as the "Trust"). <br />2. That on June 10, 2016, the Affiant became the sole successor Trustee of the Trust <br />following the execution of the Acceptance of APPOINTMENT As SUCCESSOR TRUSTEE, attached <br />hereto as Exhibit "A". <br />3. That Decedent died on June 26, 2016. A certified of Decedent' s death certificate is <br />attached as Exhibit "B". <br />3. That the Affiant remains the successor Trustee of the Trust. <br />4. That among the assets of the trust is the following described real property: <br />The South Twenty (20) feet of Lot Ninety Three (93) and the North Thirty (30) <br />feet of Lot Ninety Two (92) of Hawthorne Place, being a subdivision of part of <br />the Northwest Quarter (NW'/4) of Section Twenty Two (22) in Township Eleven <br />(11) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, <br />commonly known and numbered as 940 South Oak, Grand Island, Nebraska <br />68803. <br />5. That the trust was duly established under the laws of the State of Kansas. <br />6. That pursuant to the terms of the said trust and K.S.A. 58a-817, the successor <br />Trustee of the Trust has the power, with or without court authorization, distribute the <br />Trust property to the persons entitled to it. <br />7. That neither the Trust, or the Agreement creating the Trust, its amendments or <br />restatements have been revoked or amended, and the above statements constitutes a full <br />disclosure of all provisions concerning those items. <br />8. That this affidavit is given as evidence that pursuant to Neb. Rev. Stat. § 77-2003, <br />no inheritance tax lien arising due to the death of the Decedent can attach to the above- <br />described real estate. <br />
