JANULEWICZ and JANET D. JANULEWICZ being first duly sworn upon oath, depose and state that: 1. Affiants created The Janulewicz Family Trust upon the execution of The Janulewicz Family Trust Agreement dated June 8, 2004 (the "Trust"). Upon the execution of the First Restatement of The Janulewicz Family Trust dated September 14, 2015 (the "First Restatement of Trust") Affiants modified, amended and restated in its entirety the original Janulewicz Family Trust dated June 8, 2004. Upon the execution of the Second Restatement of The Janulewicz Family Trust dated June.? 5, 2019, Affiants modified, amended and restated in its entirety the First Restatement of Trust. In said Second Restatement of The Janulewicz Family Trust dated June (05 2019 (the "Second Restatement of Trust"), the Affiants designated themselves as the initial Co -Trustee of the Second Restatement of Trust and designated the Affiants' children, John D. Janulewicz and Kimberly D. Biltoft as successor Co -Trustees of the Trust. 2. From the date of the creation of the Trust, Affiants have served as Co -Trustees of the Trust which Trust grants Affiant as Trustee all powers under the Nebraska Uniform Trust Code and further grants either of the Co -Trustees acting independently or together the authority to exercise all powers granted to Trustees under the Nebraska Uniform Trust Code; 3. The Trust is a grantor trust and may be revoked by grantors, Gerard D. Janulewicz and Janet D. Janulewicz; 4. During the lifetime of Affiants, Affiants are the sole beneficiaries of the Trust; 5. Since the Trust remains a grantor trust Affiants' social security numbers should be used for all tax reporting purposes and no separate tax identification number for the Trust has been obtained; 6. Affiants state that (a) there are presently and have been since the inception of the Trust no other trustee appointed to serve on behalf of the Trust; (b) that Affiants are the Co - Trustees at this time, and (c) the Trust has not been revoked, subsequently amended or terminated and is in full force and effect.
