<br />RAYMOND J. O'CONNOR, being first duly sworn upon oath, deposes and states: 
<br />1. Affiant is currently, and all times material herein has been, the Managing Member of 
<br />Grand Island Venue, L.L.C., a Nebraska limited liability company. 
<br />2. Grand Island Venue, L.L.C. did, by Special Warranty Deed dated September 22, 2008, 
<br />and recorded on September 24, 2008, in the Office of the Register of Deeds of Hall County, 
<br />Nebraska, as Instrument No. 200808162, acquire title to that real estate described as: 
<br />Lot Three (3), Meadowlark West Fourth Subdivision, in the City of Grand Island, 
<br />Hall County, Nebraska. 
<br />3. Prior to Grand Island Venue, L.L.C.'s acquisition of the real estate described herein, it 
<br />was the subject of a Memorandum of Ground Lease executed between Robert M. Allen Family 
<br />Limited Partnership, a Nebraska Limited Partnership, and Albertson's Inc. dated September 22, 
<br />2000, and filed September 25, 2000, in the Office of the Register of Deeds of Hall County, 
<br />Nebraska, as Document No. 200007945, which Ground Lease was subsequently assigned by 
<br />Albertson's, Inc., a Delaware corporation, to BNS Property III, L.L.C., a Nebraska limited 
<br />liability company, by Assignment and Assumption Agreement for Ground Lease dated August 
<br />16, 2004, and filed September 3, 2004, in the Office of the Register of Deeds of Hall County, 
<br />Nebraska, as Document No. 200408870. 
<br />4. Concurrently with the purchase of the real estate described above, Grand Island 
<br />Venue, L.L.C. was provided with a Release Agreement executed in counterparts, a copy of 
<br />which is attached hereto as Exhibit "A", whereby all interests in the lease affecting the real estate 
<br />hereinabove described was conveyed by both Robert M. Allen Family Limited Partnership and 
<br />BNS Property III, L.L.C. to Grand Island Venue, L.L.C., and such lease was thereby merged into 
<br />fee title and terminated.
