89-'- 102956 <br />E A S E M E N T A G R E E M E N T <br />WHEREAS, Norman A. Kocmick and Susan 0. Kocmick, husband and <br />wife, hereinafter referred to as "KOCMICK ", whether one or more, <br />are the owners of - <br />The Southerly Eight -One (81) feet of Lot Five (5), in <br />Fractional Block Twenty -One (21) of Palmer's Subdivision in the <br />City of.Grand Island, Hall County, Nebraska, <br />WHEREAS, MARTYN J'..SHUNKWILER and JANET L. SHUNKWILER, <br />husband and wife, hereinafter referred to as "SHUNKWILER ", whether <br />one or more, are the owners of- <br />The North Fifty -One (51) feet of Lot Five-(5), in Fractional <br />Block, Twenty -One (21) of Palmer's Subdivision in the City of Grand <br />Island, Hall County, Nebraska. <br />WHEREAS, said lots adjoin each other and a common driveway <br />exists for the purpose of providing access to a garage that is <br />located on the Easterly portion of Lot Five (5), in Fractional <br />Bloch. Twenty -One (21), Palmer's Sub; and <br />:WHEREAS, the parties desire to enter into an easement <br />agreement pertaining.to casement rights for ingress aced egress <br />purposes, together with an agreement for the continued maintenance <br />of the joint and gammon driveway and garage. <br />NOW, THEREFORE, in consideration of the mutual promises t <br />hereinafter contained, the parties agree as follows: <br />A- <br />1. 1. KOCMICK hereby grants to SHUNKWILER an easement over and <br />- across that part of the Northerly portion of South Fifty -One (51) <br />feet of Lot Five (5), Block Twenty--one ( 21) of Palmer's Sub. to <br />the City of. Grand Island, Hall County, Nebraska, whereon a joint <br />driveway exists for the purpose of providing ingress and egress to <br />the Joint garage located on the Easterly portion of Lot Five (5), <br />Slock'Twenty -One (21) of Palmer's Subdivision. <br />2. SHUNKWILER hereby grants to KOCMICK an easement over and <br />across that part of the Southerly portion of the North Fifty -One <br />(51) feet of Lot Five (5) Block Twenty -One (21) of Palmer's Sub. <br />to the City of Grand Island, Hall County, Nebraska, whereon a <br />Joint driveway exists for the purpose of providing ingress and � <br />egress to the Joint garage located on the Easterly portion of Lot <br />Five (5) Block Twenty -One (21) of Palmer's Subdivisior,�.. <br />3. Each party hereto agrees to permit the other. to use the <br />Joint driveway without interruptions, and each agrees to not block <br />the joint driveway with vehicles or other objects so that the <br />other party is unable to effectively use the J.oi.nt driveway. <br />4. Each party here:t'o agrees to maintain, at his-.expense, <br />that portion of the joint: driveway located on his premises. <br />5. Since a joint garage exists on the Easterly portion of <br />Lot Five (5) Block Twenty -One (21) of Palmer's Subdivision, each <br />party hereto agrees to maintain, at his expense, that portion of <br />the garage which is situated upon his premises. The party -wall in <br />the garage shall be maintained at the joint expense of both <br />parties. <br />6. This Agreement shall run with the land and shall be <br />binding upon the parties hereto, their respective personal <br />representatives, heirs,devisees, legatees, successors and. assigns. <br />4 <br />N ORM A.
