<br />     			FERDINAND F.  FERNANDE2,  being first duly sworn,  deposes  and
<br />     		states:
<br />     			1.   During their lifetimes,  Olen Cowgill  and Gertrude Cowgill,
<br />    		named as  Trustors  in the Cowgill Land Trust dated January  27,  1970,
<br />    		were referred to the law f_irm of Allard,  Shelton  & O'Connor.   Affiant
<br />     		is and then was a partner of  said  law firm.   The business  records of
<br />    		said law firm and particularly those of  197Q  indicate that at  that
<br />    		time they stated that they were man and wife,  and affiant  believes
<br />    		that they were man  and wife  at  that time.
<br />    			2.   tiffiant i5 a iawyer  duiy  iicensed to practice in  the  State
<br />    		of California,  and  he drafted the Cowgill Land Trust  instrument which
<br />    		was executed by Mr.  and Mrs.  Cowgill on  January 27,  1970;  that by
<br />    		execution of said document  said Cowgills did establish a trust under
<br />    		which they were Trustors and  the Commercial National  Bank  and  Trust
<br />    		Company was  the Trustee.
<br />    			3.   The transfer of the  land  above-described to  said  Trustee was
<br />   		without financial consideration,  and the conveyance was made for  the
<br />   		purpose of placing  said  land  in trust under the conditions stated in
<br />    		the trust document;  that execution  of the trust document by the
<br />   		Trustee Bank and acceptance of the deed to  the described land was
<br />   		done  by the Bank in  the  capacity of a  trustee under said Trust
<br />   		Agreement,  and its  performance of duties  and handling  of assets  in the
<br />   		corpus of the Trust have been performed  as  a truste   			�'"—'
