Bosselman and Elizabeth Bosselman, <br /> husband and wife, and Bosselman, Inc., are the owners of all of the lots situated in <br /> Bosselman Subdivision, an Addition to the City of Grand Island, Nebraska, and <br /> tdHEREAS, on August 4, 1976, the owners of all of the lots in said Sub- <br /> division filed an Agreement in the Office of the Register of Deeds in Hall County, <br /> ^lebraska, recorded as Document Number 76-004301, which Agreement provides for pro- <br /> tective covenants> restrictions and conditions for said Bosselman Subdivision, and <br /> WHEREAS the undersigned owners nov! desire to modify the provisions of <br /> Paragraph 4 of said Protective Covenants, Restrictions and Conditions, <br /> NOW THEREFORE, in consideration whereof, the undersigned owners hereby <br /> stipulate and agree that such agreement for protective covenants, restrictions and con- <br /> ditions as filed aforesaid should be, and th� same is hereby modified as follows: <br /> 1. Paragraph No. 4 of the afc,. c�aid Agreement for Protective Covenants, <br /> Restrictions and Conditions is hereby deleted and in lieu thereof the following is <br /> substituted: <br /> "4. On all lots numbered 3 through 8, both inclusive, no buildings, signs <br /> or any other improvements other than seeding, shubbery, lighting fixtures, or paving <br /> � '. for parking lots and driveHiays shall be permitted or located on any lot nearer than <br /> 35 feet to the front line of such lot facing on Dier's P.ve., except as follows: <br /> a. One advertising sign per driveway shall be permitted �vhich shall not <br /> exceed in size 18 square feet and shall not have an overall installed height of in <br /> excess of 5 1/2 feet. <br /> b. Gasoline service stations, drive-in banking facilities, or any other <br /> type of business which customarily requires detached facilities may install aas <br /> ' pumps, detached deposit cages or other small structures on said premises �vtthout re- <br /> gard to the 35 foot set-back required; provided, however, that the main building <br /> and improvements thereto shall adhere to such 35 feet set-back." <br /> 2.
